INSURANCE REQUIREMENTS FOR CONTRACTOR

　　工程承包商的保險(xiǎn)責(zé)任 (工程合同附件)

　　Insurance to be taken out by the Contractor. 承包商承擔(dān)保險(xiǎn)：

　　In accordance with the provisions of contract, the Contractor shall at its expense take out and maintain in effect, or cause to be taken out and maintained in effect, during the performance of the Contract, the insurance set forth below in the sums and with the deductibles and other conditions as specified. The identity of the insurers and the form of the policies shall be subject to the approval of EMPLOYER. The costs for insurance to be included in Bid price

　　依照合同條約，承包商應(yīng)在合同履行期間投保且保持保險(xiǎn)有效，或促成投保且保持保險(xiǎn)有效，保險(xiǎn)數(shù)額、免賠額和其他條件已在下方列明。保險(xiǎn)公司的身份和保單形式應(yīng)得到雇主同意。投標(biāo)價(jià)格包含保險(xiǎn)成本。

　　1. Construction and Erection Insurance施工和安裝保險(xiǎn)

　　The following insurance shall be taken out and maintained by the Contractor during the period of delivery/installation/ construction/ field testing/commissioning/trial operation at the Site of the Works covered under the Contract:

　　在工地交付、安裝、施工、場(chǎng)地檢測(cè)、調(diào)試、試運(yùn)營(yíng)期間，承包商須投保以保持合同中以下保險(xiǎn)有效：

　　(a) Erection All Risks Insurance to cover the entire Works (permanent and/or temporary) from any and all kinds of damages which it is standard international practice for a contractor to insure under such a policy;

　　安裝一切險(xiǎn)：范圍含全部工程保險(xiǎn)(永久和/或臨時(shí)性工程保險(xiǎn))，即承包商依照保險(xiǎn)單規(guī)定按標(biāo)準(zhǔn)國(guó)際慣例投保的所有損害保險(xiǎn);

　　(b) "Third-Party Liability Insurance" to cover injury or death to persons or damages to property caused by the Works or by the Contractor's vehicles, tools and/or equipment or per Employer personnel;

　　第三方責(zé)任險(xiǎn)：范圍包括由于工程施工或承包商的車(chē)輛、工具和/或設(shè)備或工作人員造成的人員傷亡或財(cái)產(chǎn)損害;

　　(c) "Workman's Compensation Insurance". This type of insurance is required under Law to be secured by the Contractor for his employees. The Contractor shall, therefore, faithfully comply with the requirements of said law.

　　工人賠償險(xiǎn)：依照法律，此類保險(xiǎn)由承包商為員工投保。因此，承包商須完全遵守上述法律要求。

　　(d) Automobile Liability Insurance 機(jī)動(dòng)車(chē)責(zé)任保險(xiǎn)：

　　Covering use of all vehicles used by the Contractor or its Subcontractors (whether or not owned by them) in connection with the execution of the Works.

　　機(jī)動(dòng)車(chē)責(zé)任保險(xiǎn)范圍包括承包商或其分包商為執(zhí)行施工使用的所有機(jī)動(dòng)車(chē)輛(無(wú)論所述機(jī)動(dòng)車(chē)輛是否屬于承包商或其分包商所有)的責(zé)任保險(xiǎn)。

　　(e) The Contractor has the responsibility to ensure the insurances as mentioned above by the way to employ a trusty Insurance Company which is acceptable to EMPLOYER. These insurances will be effective to Final Acceptance Certificate issued by Owner specified in Contract Agreement.

　　承包商負(fù)責(zé)確保提供上述所有保險(xiǎn)，并投保守信可靠的、業(yè)主接受的保險(xiǎn)公司。上述保險(xiǎn)的有效期至業(yè)主發(fā)出合同協(xié)議規(guī)定的最終驗(yàn)收證書(shū)之日。

　　(f) Before commencing the soil investigation works at site, the Contractor shall submit the above Insurance Policies together with the official receipts evidencing premium payments.

　　Beneficiary for Erection All Risks shall be the Contractor within the Plant fence, and EMPLOYER out of the Plant fence; Beneficiary for Third Party Liability Risk shall be EMPLOYER.

　　在現(xiàn)場(chǎng)進(jìn)行土地勘察工作之前，承包商應(yīng)連同正式收據(jù)一起提交上述保險(xiǎn)單，以證明其已經(jīng)支付保險(xiǎn)金。

　　安裝一切險(xiǎn)受益人為電廠圍墻內(nèi)的承包商，以及電廠圍墻外的業(yè)主;第三者責(zé)任險(xiǎn)受益人為業(yè)主。

　　(g) Deductibles limit for Erection All Risks: 安裝一切險(xiǎn)的免賠額限制如下：

　　USD200,000.00 A.O.A for Loss or Damage due to Acts of God

　　由于自然災(zāi)害造成的任何一次事故的損失或損害扣除金額為200,000.00美元;

　　USD200,000.00 A.O.A for Loss or Damage due to Commissioning/Testing and Maintenance caused by Turbine

　　由于汽輪機(jī)的調(diào)試/測(cè)試和維修期間發(fā)生造成的任何一次事故的損失或損害扣除金額為200,000.00美元;

　　Deductible limit for Third Party Liabilities applicable for property damage: USD5000.00 A.O.A

　　適用于財(cái)產(chǎn)損害的第三方責(zé)任險(xiǎn)的免賠額限制為：一次事故5000.00美元。

　　Deductible limit for Third Party Liabilities applicable for personal injury: Nil

　　適用于人員傷害險(xiǎn)的第三方責(zé)任險(xiǎn)的免賠額限制為：零美元。

　　(h) Before PAC, the Owner shall bear the deductibles for the loss and/or damage which is caused by reason of the Owner (including his employee and consultant); If the loss and/or damage is caused by any third party, the Contractor shall bear the deductibles for the loss and/or damage which cannot be claimed from the insurer; The Contractor shall bear the deductibles for the loss and/or damage which is caused by other reason (excluding Force Majeure);From PAC to FAC, the Contractor shall bear the deductibles for the loss and/or damage which is caused by the Contractor. EMPLOYER shall bear the deductibles for the loss and/or damage which is caused by other reasons.

　　臨時(shí)驗(yàn)收之前，業(yè)主須承擔(dān)由于其(包括業(yè)主雇員和顧問(wèn)人員)造成的損失和/損害的免賠額;若上述損失和/損害由于任何第三方造成，承包商須承擔(dān)造成的損失和/損害的免賠額(該部分保險(xiǎn)金不能由保險(xiǎn)公司賠付)。承包商還須承擔(dān)由于任何其他原因(不含不可抗力因素)造成的損失和/損害的免賠額;臨時(shí)驗(yàn)收到最終驗(yàn)收期間，承包商須承擔(dān)其自己造成的損失和/損害的免賠額。由于其他原因造成的損失和/損害的免賠額則由業(yè)主承擔(dān)。

　　(i) The Contractor shall indemnify EMPLOYER against all actions, suits, claims, demands, cost or expenses arising from or in connection with any accident, illness or death (other than such as may be attributable to EMPLOYER, its agents or employees) to persons employed by the Contractor or his Subcontractor at Site. The Contractor shall indemnify EMPLOYER against all loss and/or damage arising from its improper design for the Works.

　　承包商應(yīng)確保業(yè)主免于任何由于承包商或分包商的現(xiàn)場(chǎng)人員的所有事故、疾病或死亡引起或與事故、疾病或死亡有關(guān)的(不是由于業(yè)主、其代理商或雇員引起)所有訴訟、訟案、索賠、要求、成本或費(fèi)用。承包商須向由于其工程設(shè)計(jì)不當(dāng)對(duì)業(yè)主造成的所有損失和/損害提供賠償。

　　(j) The Contractor shall initiate and successfully obtain security payments covering losses and/or damages arising out of the Contract. Failure to initiate Employer or settle the claim within a reasonable period of time shall constitute sufficient grounds for EMPLOYER to exercise its rights under the Contract. Should the Contractor fail or refuse to maintain its insurance above, EMPLOYER will secure, renew or maintain said insurance, and any and all expenses incurred thereby shall be deducted from any and all sums due or may become due to the Contractor. The Performance Bond submitted by the Contractor shall also be used where necessary to cover such expenses.

　　2. All Risk Insurance for Transportation of Equipment and Materials.

　　(a) Without prejudice to the Contractor's obligations and responsebilities under the Contract, the Contractor shall insure the equipment and materials to be supplied and delivered with a reputable insurance company acceptable to EMPLOYER. The insurance shall be taken out in the joint names of the Contractor and EMPLOYER for their respective rights and interests, and shall cover all Risks including sea and land transport, and war risk, from place of origin to the Site.

　　在與合同項(xiàng)下規(guī)定的承包商義務(wù)和責(zé)任不相沖突的情況下，承包商應(yīng)為將提供和交付的設(shè)備和材料投保一切險(xiǎn)保險(xiǎn)，承包商應(yīng)投保信用可靠的、業(yè)主接受的保險(xiǎn)公司。由承包商和業(yè)主依照各自的合同權(quán)利和利益聯(lián)名共同投保，一切險(xiǎn)范圍為從原產(chǎn)地到工程現(xiàn)場(chǎng)之間的所有運(yùn)輸保險(xiǎn)，包括海運(yùn)險(xiǎn)、陸運(yùn)險(xiǎn)、戰(zhàn)爭(zhēng)險(xiǎn)。

　　(b) The insurance coverage shall be one hundred and ten percent (110%) of the delivered cost and insurance premiums shall be paid by the Contractor. Under such insurance, the indemnity must be payable in US dollars, freely usable to replace or repair such goods. The Contractor, acting as agent for EMPLOYER, shall initiate proper action and pursue settlement regarding insurance claims whenever damages and/or losses are inflicted on the goods. The Contractor shall be authorized to receive the indemnity directly from the insurance companies unless otherwise directed by EMPLOYER.

　　保額為交付的材料或貨物的價(jià)值的百分之一十(110%)，保費(fèi)由承包商支付。依照本保險(xiǎn)單之規(guī)定，保險(xiǎn)賠付必須采用美元支付，其應(yīng)能夠自由使用，以更換或修復(fù)保險(xiǎn)賠付部分的貨物。作為業(yè)主的代理人，當(dāng)貨物出現(xiàn)任何損害和/或損失時(shí)，承包商應(yīng)采取適當(dāng)?shù)男袆?dòng)和辦法處理任何有關(guān)保險(xiǎn)索賠。除業(yè)主指示外，承包商應(yīng)獲得授權(quán)，以便直接接受保險(xiǎn)公司的賠付。

　　(c) EMPLOYER shall be named as co-insured under all insurance policies taken out by the Contractor pursuant to GC 34.1, except for Workman’s Compensation，and the Contractor's Subcontractors shall be named as co-insureds under all insurance policies taken out by the Contractor pursuant to GC 34.1 except for the Cargo Insurance During Transport, Workman's Compensation, and all insurer's rights of subrogation against such co-insureds for losses or claims arising out of the performance of the Contract shall be waived under such policies.

　　業(yè)主應(yīng)為承包商依照第GC 34.1部分規(guī)定投保的所有保險(xiǎn)的共同被保險(xiǎn)人，除了工人賠償險(xiǎn);承包商的分包商應(yīng)為承包商依照第GC 34.1部分規(guī)定投保的所有保險(xiǎn)的共同被保險(xiǎn)人，除了貨物運(yùn)輸險(xiǎn)，工人賠償險(xiǎn);在該些保險(xiǎn)單項(xiàng)下，所有承保人應(yīng)放棄對(duì)以上共同被保險(xiǎn)人的代位求償權(quán)。

　　(d) The Contractor shall, as soon as practicable but not later than one (1) month prior to the first scheduled shipment furnish a copy of the Insurance Policy to EMPLOYER.

　　The Contractor shall be responsible for any loss and/or damage of the goods shipped without the specified insurance coverage.

　　承包商應(yīng)盡快且不遲于第一批貨物裝運(yùn)之前一(1)個(gè)月將保險(xiǎn)單復(fù)印件提交給業(yè)主。

　　承包商須承擔(dān)保險(xiǎn)規(guī)定范圍之外所有運(yùn)輸貨物的損失和/損害。
