第一章 總 則
第一條 為維護(hù)中華人民共和國(guó)的主權(quán)、安全和社會(huì)秩序,有利于發(fā)展國(guó)際交往,特制定本法。外國(guó)人入、出、通過(guò)中華人民共和國(guó)國(guó)境和在中國(guó)居留、旅行,適用本法。
第二條 外國(guó)人入境、過(guò)境和在中國(guó)境內(nèi)居留,必須經(jīng)中國(guó)政府主管機(jī)關(guān)許可。
第三條 外國(guó)人入境、出境、邊境,必須從對(duì)外國(guó)人開放的或者指定的口岸通行,接受過(guò)防檢查機(jī)關(guān)的檢查。外國(guó)的交通工具入境、出境、邊境,必須從對(duì)外國(guó)人開放的或者指定的口岸通行,接受過(guò)防檢查機(jī)關(guān)的檢查和監(jiān)護(hù)。
第四條 中國(guó)政府保護(hù)在中國(guó)境內(nèi)的外國(guó)人的合法權(quán)利和利益。外國(guó)人的人身自由不受侵犯,非經(jīng)人民檢察院批準(zhǔn)或者決定或者人民法院決定,并由公安機(jī)關(guān)或者國(guó)家安全機(jī)關(guān)執(zhí)行,不受逮捕。
第五條 外國(guó)人在中國(guó)境內(nèi),必須遵守中國(guó)法律,不得危害中國(guó)國(guó)家安全、損害社會(huì)公共利益、破壞社會(huì)公共秩序。
第二章 入 境
第六條 外國(guó)人入境,應(yīng)當(dāng)向中國(guó)的外交代表機(jī)關(guān)、領(lǐng)事機(jī)關(guān)或者外交部授權(quán)的其他駐外機(jī)關(guān)申請(qǐng)辦理簽證。在特定情況下,依照國(guó)務(wù)院規(guī)定,外國(guó)人也可以向中國(guó)政府主管機(jī)關(guān)指定口岸的簽證機(jī)關(guān)申請(qǐng)辦理簽證。同中國(guó)政府訂有簽證協(xié)議的國(guó)家的人員入境,按照協(xié)議執(zhí)行。外國(guó)對(duì)中國(guó)公民入境、過(guò)境有專門規(guī)定的,中國(guó)政府主管機(jī)關(guān)可以根據(jù)情況采取相應(yīng)措施。持聯(lián)程客票搭乘國(guó)際航班直接過(guò)境,在中國(guó)停留不超過(guò)二十四小時(shí)不出機(jī)場(chǎng)的外國(guó)人,免辦簽證。要求臨時(shí)離開機(jī)場(chǎng)的,需經(jīng)防檢查機(jī)關(guān)批準(zhǔn)。
第七條 外國(guó)人申請(qǐng)各項(xiàng)簽證,應(yīng)當(dāng)提供有效護(hù)照,必要時(shí)提供有關(guān)證明。
第八條 應(yīng)聘或者受雇來(lái)中國(guó)工作的外國(guó)人,申請(qǐng)簽證時(shí),應(yīng)當(dāng)持有應(yīng)聘或者受雇證明。
第九條 來(lái)中國(guó)定居的外國(guó)人,申請(qǐng)簽證時(shí),應(yīng)當(dāng)持有定居身份確認(rèn)表。定居身份確認(rèn)表,由申請(qǐng)人向申請(qǐng)定居地的公安機(jī)關(guān)申請(qǐng)領(lǐng)取。
第十條 中國(guó)政府主管機(jī)關(guān)根據(jù)外國(guó)人申請(qǐng)入境的事由,發(fā)給相應(yīng)的簽證。
第十一條 從事國(guó)際航行的航空器或者船舶抵達(dá)中國(guó)口岸時(shí),機(jī)長(zhǎng)、船長(zhǎng)或者代理人必須向過(guò)防檢查機(jī)關(guān)提交旅客名單;外國(guó)的飛機(jī)、船舶還必須提供機(jī)組、船員名單。
第十二條 被認(rèn)為入境后可能危害中國(guó)的國(guó)家安全、社會(huì)秩序的外國(guó)人,不準(zhǔn)入境。
第三章 居 留
第十三條 外國(guó)人在中國(guó)居留,必須持有中國(guó)政府主管機(jī)關(guān)簽發(fā)的身份證件或者居留證件。身份證件或者居留證件的有效期限,根據(jù)入境的事由確定。在中國(guó)居留的外國(guó)人,應(yīng)當(dāng)在規(guī)定的時(shí)間內(nèi)到當(dāng)?shù)毓矙C(jī)關(guān)繳驗(yàn)證件。
第十四條 依照中國(guó)法律在中國(guó)投資或者同中國(guó)的企業(yè)、事業(yè)單位進(jìn)行經(jīng)濟(jì)、科學(xué)技術(shù)、文化合作以及其他需要在中國(guó)長(zhǎng)期居留的外國(guó)人,經(jīng)中國(guó)政府主管機(jī)關(guān)批準(zhǔn),可以獲得長(zhǎng)期居留或者永久居留資格。
第十五條 對(duì)因?yàn)檎卧蛞蟊茈y的外國(guó)人,經(jīng)中國(guó)政府主管機(jī)關(guān)批準(zhǔn),準(zhǔn)許在中國(guó)居留。
第十六條 對(duì)不遵守中國(guó)法律的外國(guó)人,中國(guó)政府主管機(jī)關(guān)可以縮短其在中國(guó)停留的期限或者取消其在中國(guó)居留的資格。
第十七條 外國(guó)人在中國(guó)境內(nèi)臨時(shí)住宿,應(yīng)當(dāng)依照規(guī)定,辦理住宿登記。
第十八條 持居留證件的外國(guó)人在中國(guó)變更居留地點(diǎn),必須依照規(guī)定辦理遷移手續(xù)。
第十九條 未取得居留證件的外國(guó)人和來(lái)中國(guó)留學(xué)的外國(guó)人,未經(jīng)中國(guó)政府主管機(jī)關(guān)允許,不得在中國(guó)就業(yè)。
第四章 旅 行
第二十條 外國(guó)人持有效的簽證或者居留證件,可以前往中國(guó)政府規(guī)定的對(duì)外國(guó)人開放的地區(qū)旅行。
第二十一條 外國(guó)人前往不對(duì)國(guó)外人開放的地區(qū)旅行,必須向當(dāng)?shù)毓矙C(jī)關(guān)申請(qǐng)旅行證件。
第五章 出 境
第二十二條 外國(guó)人出境,憑本人有效護(hù)照或者其他有效證件。
第二十三條 有下列情形之一的外國(guó)人,不準(zhǔn)出境:
(一)刑事案件的被告人和公安機(jī)關(guān)或者人民檢察院或者人民法院認(rèn)定的犯罪嫌疑人;
(二)人民法院通知有未了結(jié)民事案件不能離境的;
(三)有其他違反中國(guó)法律的行為尚未處理,經(jīng)有關(guān)主管機(jī)關(guān)認(rèn)定需要追究的。
第二十四條 有下列情形之一的外國(guó)人,邊防檢查機(jī)關(guān)有權(quán)阻止出境,并依法處理:
(一)持用無(wú)效出境證件的;
(二)持用他人出境證件的;
(三)持用偽造或者涂改的出境證件的。
第六章 管理機(jī)關(guān)
第二十五條 中國(guó)政府在國(guó)外受理外國(guó)人入境、過(guò)境申請(qǐng)的機(jī)關(guān),是中國(guó)的外交代表機(jī)關(guān)、領(lǐng)事機(jī)關(guān)和外交部授權(quán)的其他駐外機(jī)關(guān)。中國(guó)政府在國(guó)內(nèi)受理外國(guó)人入境、過(guò)境、居留、旅行申請(qǐng)的機(jī)關(guān),是公安部、公安部授權(quán)的地方公安機(jī)關(guān)和外交部、外交部授權(quán)的地方外事部門。
第二十六條 受理外國(guó)人入境、過(guò)境、居留、旅行申請(qǐng)的機(jī)關(guān)有權(quán)拒發(fā)簽證、證件;對(duì)已經(jīng)發(fā)出的簽證、證件,有權(quán)吊銷或者宣布作廢。公安部和外交部在必要時(shí),可以改變各自授權(quán)的機(jī)關(guān)所作出的決定。
第二十七條 對(duì)非法入境、非法居留的外國(guó)人,縣級(jí)以上公安機(jī)關(guān)可以拘留審查、監(jiān)視居住或者遣送出境。
第二十八條 縣級(jí)以上公安機(jī)關(guān)外事民警在執(zhí)行任務(wù)時(shí),有權(quán)查驗(yàn)外國(guó)人的護(hù)照和其他證件。外事民警查驗(yàn)時(shí),應(yīng)當(dāng)出示自己的工作證件,有關(guān)組織或者個(gè)人有協(xié)助的責(zé)任。
第七章 處 罰
第二十九條 對(duì)違反本法規(guī)定,非法入境、出境的,在中國(guó)境內(nèi)非法居留或者停留的,未持有效旅行證件前往不對(duì)外國(guó)人開放的地區(qū)旅行的,偽造、涂改、冒用、轉(zhuǎn)讓入境、出境
證件的,縣級(jí)以上公安機(jī)關(guān)可以處以警告、罰款或者十日以下拘留處罰;情節(jié)嚴(yán)重,構(gòu)成犯罪的,依法追究刑事責(zé)任。受公安機(jī)關(guān)罰款或者拘留處罰的外國(guó)人,對(duì)處罰不服的,在接到通知之日起十五日內(nèi),可以向上一級(jí)公安機(jī)關(guān)提出申訴,由上一級(jí)公安機(jī)關(guān)作出最后裁決,也可以直接向當(dāng)?shù)厝嗣穹ㄔ禾崞鹪V訟。
第三十條 有本法第二十九條所列行為情節(jié)嚴(yán)重的,公安部可以處以限期出境或者驅(qū)逐出境處罰。
第八章 附 則
第三十一條 本法所稱的外國(guó)人是指依照《中華人民共和國(guó)國(guó)籍法》不具有中國(guó)國(guó)籍的人。
第三十二條 同中國(guó)毗鄰國(guó)家的外國(guó)人,居住在兩國(guó)邊境接壤地區(qū)的,臨時(shí)入中國(guó)國(guó)境、出中國(guó)國(guó)境,有兩國(guó)之間協(xié)議的按照協(xié)議執(zhí)行,沒(méi)有協(xié)議的按照中國(guó)政府的規(guī)定執(zhí)行。
第三十三條 公安部和外交部根據(jù)本法制定實(shí)施細(xì)則,報(bào)國(guó)務(wù)院批準(zhǔn)施行。
第三十四條 外國(guó)駐中華人民共和國(guó)外交代表機(jī)關(guān)、領(lǐng)事機(jī)關(guān)成員以及享有特權(quán)和豁免的其他外國(guó)人入境后的管理,按國(guó)務(wù)院及其主管機(jī)關(guān)的有關(guān)規(guī)定辦理。
第三十五條 本法自一九八六年二月一日起施行。

LAW OF THE PEOPLE'S REPUBLIC OF CHINA ON CONTROL OF THE ENTRY AND EXIT OF ALIENS

President of the People's Republic of China on November 22, 1985, and effective as of February 1, 1986)

Chapter I General Provisions
Article 1
This Law is formulated with a view to safeguarding the sovereignty of the People's Republic of China, maintaining its security and public order and facilitating international exchange.This Law is applicable to aliens entering, leaving and transiting the territory of the People's Republic of China and to those residing and travelling in China.
Article 2
Aliens must obtain the permission of the competent authorities of the
Chinese Government in order to enter, transit or reside in China.
Article 3
For entry, exit and transit, aliens must pass through ports open to aliens or other designated ports and must be subject to inspection by the frontier inspection offices.For entry, exit and transit, foreign-owned means of transport must pass through ports open to aliens or other designated ports and must be subject to inspection and supervision by the frontier inspection offices.
Article 4
The Chinese Government shall protect the lawful rights and interests of
aliens on Chinese territory.Freedom of the person of aliens is inviolable. No alien may be arrested except with the approval or by decision of a people's procuratorate or by decision of a people's court, and arrest must be made by a public security organ or state security organ.
Article 5
Aliens in China must abide by Chinese laws and may not endanger the state security of China, harm public interests or disrupt public order.
Chapter II Entry into the Country
Article 6
For entry into China, aliens shall apply for visas from Chinese diplomatic missions, consular offices or other resident agencies abroad authorized by the Ministry of Foreign Affairs. In specific situations aliens may, in compliance with the provisions of the State Council, apply for visas to visa-granting offices at ports designated by the competent authorities of the Chinese Government. The entry of nationals from countries having visa agreements with the Chinese Government shall be handled in accordance with those agreements. In cases where another country has special provisions for Chinese citizens entering and transiting that country, the competent authorities of the
Chinese Government may adopt reciprocal measures contingent on the
circumstances. Visas are not required for aliens in immediate transit on connected international flights who hold passenger tickets and stay for no more than 24 hours in China entirely within airport boundaries. Anyone desiring to leave the airport temporarily must obtain permission from the frontier inspection office.
Article 7
When applying for various kinds of visas, aliens shall present valid
passports and, if necessary, provide pertinent evidence.
Article 8
Aliens who have been invited or hired to work in China shall, when
applying for visas, produce evidence of the invitation or employment.
Article 9
Aliens desiring to reside permanently in China shall, when applying for
visas, present status-of-residence identification forms. Applicants may
obtain such forms from public security organs at the place where they
intend to reside.
Article 10
The competent authorities of the Chinese Government shall issue
appropriate visas to aliens according to the purposes stated in their
entry applications.
Article 11
When an aircraft or a vessel navigating international routes arrives at a Chinese port, the captain or his agent must submit a passenger name list to the frontier inspection office; a foreign aircraft or vessel must also provide a name list of its crew members.
Article 12
Aliens who are considered a possible threat to China's state security and public order shall not be permitted to enter China.
Chapter III Residence
Article 13
For residence in China, aliens must possess identification papers or
residence certificates issued by the competent authorizes of the Chinese Government. The term of validity of identification papers or residence certificates shall be determined according to the purposes of entry. Aliens residing in China shall submit their certificates to the local public security organs for examination within the prescribed period of time.
Article 14
Aliens who, in compliance with Chinese laws, find it necessary to
establish prolonged residence in China for the purpose of investing in
China or engaging in cooperative projects with Chinese enterprises or
institutions in the economic, scientific, technological and cultural
fields, or for other purposes, are eligible for prolonged or permanent
residence in China upon approval by the competent authorities of the
Chinese Government.
Article 15
Aliens who seek asylum for political reasons shall be permitted to reside in China upon approval by the competent authorities of the Chinese Government.
Article 16
Aliens who fail to abide by Chinese laws may have their period of stay in China curtailed or their status of residence in China annulled by the competent authorities of the Chinese Government.
Article 17
For a temporary overnight stay in China, aliens shall complete
registration procedures pursuant to the relevant provisions.
Article 18
Aliens holding residence certificates who wish to change their place of
residence in China must complete removal formalities pursuant to the
relevant provisions.
Article 19
Aliens who have not acquired residence certificates or who are on a study programme in China may not seek employment in China without permission of the competent authorities of the Chinese Government.
Chapter IV Travel
Article 20
Aliens who hold valid visas or residence certificates may travel to places open to aliens as designated by the Chinese Government.
Article 21
Aliens desiring to travel to places closed to aliens must apply to local public security organs for travel permits.
Chapter V Exit from the Country
Article 22
For exit from China, aliens shall present their valid passports or other valid certificates.
Article 23
Aliens belonging to any of the following categories shall not be allowed to leave China:
(1) defendants in criminal cases or criminal suspects confirmed by a
public security organ, a people's procuratorate or a people's court;
(2) persons who, as notified by a people's court, shall be denied exit
owing to involvement in unresolved civil cases; and
(3) persons who have committed other acts in violation of Chinese law who have not been dealt with and against whom the competent authorities
consider it necessary to institute prosecution.
Article 24
Frontier inspection offices shall have the power to stop aliens belonging to any of the following categories from leaving the country and to deal with them according to law:
(1) holders of invalid exit certificates;
(2) holders of exit certificates other than their own; and
(3) holders of forged or altered exit certificates.
Chapter VI Administrative Organs
Article 25
China's diplomatic missions, consular offices and other resident agencies abroad authorized by the Ministry of Foreign Affairs shall be the Chinese Government's agencies abroad to handle aliens' applications for entry and transit.
The Ministry of Public Security, its authorized local public security
organs, the Ministry of Foreign Affairs and its authorized local foreign affairs departments shall be the Chinese Government's agencies in China to handle aliens' applications for entry, transit, residence and travel.
Article 26
The authorities handling aliens' applications for entry,transit,
residence and travel shall have the power to refuse to issue visas and
certificates or to cancel visas and certificates already issued or declare them invalid.
The Ministry of Public Security and the Ministry of Foreign Affairs may,when necessary, alter decisions made by their respectively authorized agencies.
Article 27
An alien who enters or resides in China illegally may be detained for
examination or be subjected to residential surveillance or deportation by a public security organ at or above the county level.
Article 28
While performing their duties, foreign affairs police of the public
security organs at or above the county level shall have the power to
examine the passports and other certificates of aliens. When conducting
such examinations, the foreign affairs police shall produce their own
service certificates, and relevant organizations or individuals shall have the duty to offer them assistance.
Chapter VII Penalties
Article 29
If a person, in violation of the provisions of this Law, enters or leaves China illegally, establishes illegal residence or makes an illegal stopover in China, travels to places closed to aliens without a valid travel document, forges or alters an entry or exit certificate, uses another person's certificate as his own or transfers his certificate, he may be penalized by a public security organ at or above the county level with a warning, a fine or detention for not more than ten days.If thecircumstances of the case are serious enough to constitute a crime,criminal responsibility shall be investigated in accordance with the law.
If an alien subject to a fine or detention by a public security organ
refuses to accept the penalty, he may, within 15 days of receiving
notification, appeal to the public security organ at the next higher
level, which shall make the final decision; he may also directly file suit in the local people's court.
Article 30
In cases where a person commits any of the acts stated in Article 29 of
this Law, if the circumstances are serious, the Ministry of Public
Security may impose a penalty by ordering him to leave the country within a certain time or may expel him from the country.
Chapter VIII Supplementary Provisions
Article 31
For the purposes of this Law the term "alien" means any person not holding Chinese nationality according to the Nationality Law of the People's
Republic of China.
Article 32
Transistory entry into and exit from China by aliens who are nationals of a country adjacent to China and who reside in areas bordering on China shall be handled according to any relevant agreements between the two countries or, in the absence of such agreements, according to the relevant provisions of the Chinese Government.
Article 33
The Ministry of Public Security and the Ministry of Foreign Affairs shall,pursuant to this Law, formulate rules for its implementation, which shall go into effect after being submitted to and approved by the State Council.
Article 34
Affairs concerning members of foreign diplomatic missions and consular
offices in the People's Republic of China and other aliens who enjoy
diplomatic privileges and immunities, after their entry into China, shall be administered in accordance with the relevant provisions of the State Council and its competent departments.
Article 35
This Law shall go into effect on February 1, 1986.
