EMPLOY CONTRACT OF FOREIGN CULTURAL & EDUCATIONAL EXPERTS

　　V. Party A's Obligations聘方的義務(wù)：

　　1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A' work system and regulations concerning administration of foreign experts.

　　向受聘方介紹中國有關(guān)法律、法規(guī)和聘方有關(guān)工作制度以及有關(guān)外國專家的管理規(guī)定。

　　2. Party A shall conduct direction, supervision and evaluation of Party B's work.

　　對受聘方的工作進行指導(dǎo)、檢查和評估。

　　3. Party A shall provide Party B with necessary working and living conditions.

　　向受聘方提供必要的工作和生活條件。

　　4. Party A shall provide co-workers. 配備合作共事人員。

　　5. Party A shall pay Party B's salary regularly by the month. 每月按時支付受聘方的報酬。

　　VI. Party B's obligations受聘方的義務(wù):

　　1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China's internal affairs.

　　遵守中國的法律、法規(guī)，不干預(yù)中國的內(nèi)部事務(wù)。

　　2. Party B shall observe Party A's work system and regulations concerning administration of foreign experts and shall accept Party A's arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A's consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

　　遵守聘方的工作制度和有關(guān)外國專家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導(dǎo)、檢查和評估。未經(jīng)聘方同意，不得兼任與聘方無關(guān)的其他勞務(wù)。

　　3. Party B shall complete the tasks agreed on schedule and guarantee the quality of work.

　　按期完成工作任務(wù)，保證工作質(zhì)量。

　　4. Party B shall respect China's religious policy, and shall not conduct religious activities incompatible with the status of an expert.

　　尊重中國的宗教政策。不從事與專家身份不符的活動。

　　5. Party B shall respect the Chinese people's moral standards and customs.

　　尊重中國人民的道德規(guī)范和風俗習(xí)慣。

　?、? Revision, Cancellation and Termination of the Contract合同的變更、解除和終止：

　　1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.

　　雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不得擅自更改、解除和終止合同

　　2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.

　　經(jīng)當事人雙方協(xié)商同意后，可以變更、解除和終止合同。在未達成一致意見前，仍應(yīng)當嚴格履行合同。

　　3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions;

　　聘方在下述條件下，有權(quán)以書面形式通知受聘方解除合同：

　　(1)Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.

　　受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的。

　　(2) According to the doctor's diagnosis, Party B cannot resume normal work after a continued 30 days sick leave.

　　根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的。

　　4. Party B has the right to cancel the contract with a written notice to party A under the following conditions:

　　受聘方在下述情況下，有權(quán)以書面形式通知聘方解除合同：

　　(1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.

　　聘方未按合同約定提供受聘方必要的工作和生活條件;

　　(2) Party A has not paid Party B as scheduled. 聘方未按時支付受聘方報酬。

　?、? Breach Penalty違約金：

　　When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US$800 to 3,000 (or the equivalent in RMB).

　　當事人一方不履行合同或者履行合同義務(wù)不符合約定條件，即違反合同時，應(yīng)當向另一方支付8003000美元(或相當數(shù)額的人民幣)的違約金。

　　If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A's consent, and pay its own return expenses; If Party B cancels the contract without valid reason, it should pay its own return expenses and pay breach penalty to Party A. If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B's return expenses; if Party A cancels the contract without valid reason, it should pay Party B's return expenses and pay a breach penalty to Party B.

　　受聘方因不可抗力事件要求解除合同，需出具有關(guān)機構(gòu)證明，經(jīng)聘方同意后，離華的費用自理;受聘方若無故解除合同，除離華費用自理外，還應(yīng)當向聘方支付違約金。聘方因不可抗力事件要求解除合同，經(jīng)受聘方同意后，離華費用由聘方負擔;聘方若無故解除合同，除負擔受聘方離華費用外，還應(yīng)當向受聘方支付違約金。

　?、? The appendix of this contract is an inseparable part of the contract and has equal effect.

　　本合同附件為合同不可分割的一部分，與合同具有同等效力。

　?、? This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 60 days prior to the expiration of the contract, and sign the new contract with mutual consent. Party B shall bear all expenses incurred when staying on after the contract expires.

　　本合同自雙方簽字之日起生效，合同期滿即自行失效。當事人一方要求簽訂新合同，必須在本合同期滿60天前向另一方提出，經(jīng)雙方協(xié)商同意后簽訂新合同。受聘方合同期滿后，在華逗留期間的一切費用自理。

　　Ⅺ. Arbitration仲裁

　　The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Administration of Foreign Experts Affairs and ask for a final arbitration.

　　當事人雙方發(fā)生合同糾紛時，盡可能通過協(xié)商或者調(diào)解解決。若協(xié)商、調(diào)解無效，可向國家外國專家局設(shè)立的外國文教專家事務(wù)仲裁機構(gòu)申請仲裁。

　　THE APPENDIX 聘用合同附件

　　Ⅰ Work assignment (The business department shall list the work assignment that the employed party is supposed to undertake in details. There shall be requirements on quality of the work the employed party undertakes.)

　　工作任務(wù)(工作任務(wù)要詳細列出，不能簡單化，對受聘方的工作應(yīng)有質(zhì)量要求)

　　16 periods (50 minutes per period) each week, as well as corresponding preparations, students' homework reading and tutorship, test grading time. Any extra hours of teaching will be paid at the rate of RMB100 yuan per period. If Party B's working time within the academic year is less than 16 per week, or the contract termination date is later than the last day on the academic calendar, the employee will be assigned the other work like proofreading and error correction, , giving lectures for activities, etc. The employee shall agree t o this.

　　課堂教學(xué)每周16節(jié)(每節(jié)50分鐘),及相應(yīng)的備課、學(xué)生作業(yè)閱讀和輔導(dǎo)、考試批閱的時間;超過將每節(jié)支付人民幣100元。如在學(xué)年內(nèi)每周教學(xué)少于規(guī)定課時，或合同終止之日遲于學(xué)期結(jié)束之日，聘方將安排受聘方其他工作，如校對和改錯，為活動做演講等。受聘方要同意這些安排。

　　Ⅱ The salary 工資待遇

　　1.Direct payment直接報酬(貨幣工資)

　　Monetary salary RMB Yuan/month. The salary will be paid monthly with RMB from to the termination date of the contract. In case the time is shorter than a whole month, the payment shall be counted by day. The daily wage shall be 1/30 of the monthly salary. The employed party shall pay the personal income tax in accord with the Personal Income Tax Law of The People's Republic of China.

　　每月人民幣 元。工資以人民幣支付，工資自 日起發(fā)至合同終止之日止。按月發(fā)給，不足整月的，按日計發(fā)。日工資為月工資的1/30。受聘方應(yīng)當按照《中華人民共和國個人所得稅法》依法交納個人所得稅。

　　2. Indirect payment間接報酬

　　The employing party will guarantee the fundamental living conditions for the employed party in China:

　　聘方將保障受聘方在華生活的基本條件：

　　1) Providing lodging with furniture, bedding, telephone, television, refrigerator, toilet, kitchen, heating and cooling facilities. The university will pay 200 RMB per month for water and electricity, which will be deducted from the water and electricity bill directly. The university will pay another 100 RMB per month for telephone bill.

　　提供附設(shè)家具、臥具、電話、電視機，電冰箱、衛(wèi)生間、廚房、取暖和降溫設(shè)備的住房。聘方每月支付200元人民幣的水電費，將直接從水電費的賬單上扣除。另外，聘方每月支付100元人民幣的電話費，將直接從電話費賬單上扣除。

　　2) Medical care. The employing party will buy medical insurance for foreign experts, besides, they can reimburse RMB 50.00 yuan per month from the university.

　　醫(yī)療: 聘方將為受聘方購買醫(yī)療保險，另外，受聘方每月可從聘方報銷50元的醫(yī)療費用。

　　3) International air ticket. Party A will pay RMB 8000 to Party B for the international air ticket for one contract year. If the contract period is one semester, party A will pay RMB 4000.

　　國際機票：在一個合同年內(nèi)聘方將支付8000元國際機票補貼，聘期為半年的付4000元。

　　4)Arrival and departure ride. The university will provide one arrival and one departure ride to the nearest airport, train station or bus station.

　　往返接送：聘方提供最近的機場，火車站或汽車站的一次到達和一次出發(fā)的接送。

　　5) The travel allowance. The university will pay the employed party RMB 2200Yuan as travel allowance for a year contract. It will be paid twice a year: 1100 Yuan for the first half year and the other 1100 Yuan for the left half year.

　　旅游津貼：如果雙方簽定的合同期為1年，聘方將支付受聘方旅游津貼2200元人民幣。一年分兩次支付：前半年付1100元，后半年再付1100元。

　　6)Tours. The university will organize one or two short distance tours within Zhejiang province or surrounding areas for Party B in one contract year.

　　旅游：學(xué)校每年組織受聘方一到兩次浙江省內(nèi)或周邊地區(qū)的短途旅游。

　　5) The employed party is entitled to have Chinese language classes for free.

　　受聘方可以免費學(xué)習(xí)漢語言課程。

　　6)The employer party will arrange one activity per contract year for New Year.

　　聘方每年組織一次新年聚會活動。

　?、?Work Time, Rest and Holidays 工作時間和休息休假

　　1. The work time of the employed party shall be 8 hours every day, and 5 days every week.

　　受聘方每日工作時間為八小時，每周工作時間為五天。

　　2. If the host institution arranges overtime work for the party employed, it will pay the employed party a salary higher than that normal work time according to legal standard.

　　聘方安排受聘方延長工作時間，將依據(jù)法定標準支付高于正常工作時間的工資報酬。

　　3. The party employed is entitled to the following holidays and festivals in China:

　　New Year's Day, Spring Festival, Tomb-sweeping Day, May Day, Dragon Boat Day, National Day and other holidays stipulated by laws and regulations.

　　受聘方享受中國下列節(jié)日休假：元旦、春節(jié)、清明節(jié)、國際勞動節(jié)、端午節(jié)、國慶節(jié)以及法律、法規(guī)規(guī)定的其他節(jié)假日。

　　5. Employed party for one academic year contract is entitled to a paid winter vocation.

　　受聘方合同期為一學(xué)年的，享受寒假帶薪休假。

　　6. As a rule the party employed is supposed to work in China not longer than 5 continuous years. The next employment in China should be two years after.

　　受聘方連續(xù)在華工作一般不得超過五年，再次應(yīng)聘來華工作須在兩年以后。

　?、?Sick leave and private affairs leave 病假和事假

　　1. Certificate from doctors for foreigners appointed by the host institution should be presented when the employed party asks for sick leave. If the sick leaves amount to less than 30 days within one contract term (one year or one academic year), the party employed shall be paid with 100% of the salary. In case the leaves exceed 30 days, the host institution has the right to terminate the contract, or, if the contract is not terminated, the 70% of the salary will be paid until the normal work is resumed.

　　受聘方請病假，須憑聘方指定的涉外醫(yī)生證明，受聘方在一個合同期(一年或一學(xué)年)內(nèi)，累計病假不滿三十天，工資按照100%發(fā)給;超過三十天后，聘方有權(quán)解除聘用合同;若未解除合同，工資將按70%發(fā)給，直至恢復(fù)正常工作為止。

　　2. During the term of the contract, the medical care expenses of the employed party in the hospital foreigners appointed by the local government during business errands shall be paid by the host institution; the medical expenses incurred during private travels shall be covered by the employed party.

　　在合同期內(nèi)受聘方因公在中國境內(nèi)出差，在當?shù)卣付ǖ纳嫱忉t(yī)院就診的醫(yī)療費用，由聘方支付;因私外出就診的醫(yī)療費用自理。

　　During the term of the contract, medical expenses incurred in Taiwan province, Hong Kong SAR, Macao SAR and places outside China will be covered by the employed party.

　　在合同期內(nèi)，受聘方在臺灣、香港、澳門地區(qū)和中國境外就診的醫(yī)療費用自理。

　　3. Private affairs leave of the employed party shall be approved by the host institution. The host institution will deduct the salary by day. In the contract term (one year or one academic year), the private affairs leaves should not exceed 10 days. The continuous private affairs leave shall be no more than 3 days, and two days' salary will be deducted for each day thereafter.

　　受聘方請事假須經(jīng)聘方同意，聘方將按日扣發(fā)工資，在合同期(一年或一學(xué)年)內(nèi)，事假累計不得超過十天，連續(xù)事假不得超過三天：超過一天，將扣發(fā)兩天工資。

　　4. In case of absence from work without the host institution's permission during the contract term (one year or one academic year), 3 days' salary will be deducted for each day absent. For serious circumstances, the host institution has the right to terminate the contract and investigate the liability of the employed party for violation of the contract. If Party B has held the certification from the host department and he or she has finished all the corresponding work, he or she can submit the dismissal application to the international office. If Party A consents to Party B's application, Party B should go through the formalities of dismissal, and the salary will be paid to the date of dismissal.

　　在合同期內(nèi)未經(jīng)聘方同意而擅離職守的，曠職一天，扣發(fā)三天工資，情節(jié)嚴重的，聘方有權(quán)解除合同，并追究受聘方的違約責任。如已獲得所在學(xué)院書面證明，確認其已提前完成相應(yīng)工作任務(wù)，受聘方可向聘方遞交離職申請，如聘方同意其提前離職，受聘方應(yīng)辦理離職手續(xù)，工資支付至離職之日止。

　?、?The Probation period of the Contract 合同試用期

　　The probation period of the employed party shall be 30 days. In the probation period, if the host institution finds out that the employed party is unfit for the assignment specified in the contract for reasons of health or professional ability, it has the right to terminate the contract. The employed party will bear return expenses.

　　受聘方的試用期為30天，在試用期內(nèi)，聘方如發(fā)現(xiàn)受聘方健康狀況或?qū)I(yè)水平等不能勝任本聘用合同規(guī)定的工作任務(wù)，有權(quán)解除合同。受聘方將承擔返程費用。

　?、?Regulations for making up classes 補課規(guī)定

　　In order to finish teaching task of the academic year, the school teaching section generally arranges make-up classes for those courses missed by holidays stipulated by law. The party employed needs to abide by such arrangements.

　　為完成學(xué)年教學(xué)任務(wù)，學(xué)校教學(xué)部門一般會在一定時間安排補課，來彌補因法定假日所耽誤的課程。受聘方要服從教學(xué)部門安排。

　　Ⅶ Safety regulations 安全規(guī)定

　　The employing party will have the responsibility to give the employed party appropriate guidance on safety concerns. The employed party should be aware of personal safety and supply the employing party with his/her travel plans, route and schedule for the vacation. The employed party will guarantee that he/she will inform the employing party at once if any safety incident should occur during the vacation.

　　聘方有對受聘方加強安全指導(dǎo)的義務(wù)。受聘方須在聘方的指導(dǎo)下做好自身的安全工作，并把假期的行程安排報告給聘方，對自己的安全負責。受聘方保證若在假期發(fā)生任何涉及安全的事件，第一時間通知學(xué)校。

　?、?Confirmation and change of every term of the appendix of the standard contract must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid.

　　聘用合同附件各項條款的確定和變更均須由當事人雙方協(xié)商，并以書面形式做出約定, 任何口頭協(xié)議均視為無效。

　　IX Supplementary provision補充條款

　　This appendix has equal validity of the standard contract and comprises an integral part of the contract.

　　本附件與標準聘用合同具有同等效力，是合同不可分割的一部分。
