INTRODUCTORY NOTE介紹性說明
The Charter of the United Nations was signed on 26 June 1945, in San Francisco, at the conclusion of the United Nations Conference on International Organization, and came into force on 24 October 1945. The Statute of the International Court of Justice is an integral part of the Charter.
聯(lián)合國憲章是1945年6月26日聯(lián)合國國際組織會(huì)議結(jié)束時(shí)在舊金山簽字的,于1945年10月24日生效。國際法院規(guī)約是憲章的組成部分。
Amendments to Articles 23, 27 and 61 of the Charter were adopted by the General Assembly on 17 December 1963 and came into force on 31 August 1965. A further amendment to Article 61 was adopted by the General Assembly on 20 December 1971, and came into force on 24 September 1973. An amendment to Article 109, adopted by the General Assebmly on 20 December 1965, came into force on 12 June 1968.

The amendment to Article 23 enlarges the membership of the Security Council from eleven to fifteen. The amended Article 27 provides that decisions of the Security Council on procedural matters shall be made by an affirmative vote of nine members (formerly seven) and on all other matters by an affirmative vote of nine members (formerly seven), including the concurring votes of the five permanent members of the Security Council.

The amendment to Article 61, which entered into force on 31 August 1965, enlarged the membership of the Economic and Social Council from eighteen to twenty-seven. The subsequent amendment to that Article, which entered into force on 24 September 1973, further increased the membership of the Council from twenty-seven to fifty-four.
The amendment to Article 109, which relates to the first paragraph of that Article, provides that a General Conference of Member States for the purpose of reviewing the Charter may be held at a date and place to be fixed by a two-thirds vote of the members of the General Assembly and by a vote of any nine members (formerly seven) of the Security Council. Paragraph 3 of Article 109, which deals with the consideration of a possible review conference during the tenth regular session of the General Assembly, has been retained in its original form in its reference to a "vote, of any seven members of the Security Council", the paragraph having been acted upon in 1955 by the General Assembly, at its tenth regular session, and by the Security Council.

WE THE PEOPLES OF THE UNITED NATIONS DETERMINED
to save succeeding generations from the scourge of war, which twice in our lifetime has brought untold sorrow to mankind, and to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small, and to establish conditions under which justice and respect for the obligations arising from treaties and other sources of international law can be maintained, and to promote social progress and better standards of life in larger freedom, AND FOR THESE ENDS to practice tolerance and live together in peace with one another as good neighbours, and to unite our strength to maintain international peace and security, and to ensure, by the acceptance of principles and the institution of methods, that armed force shall not be used, save in the common interest, and to employ international machinery for the promotion of the economic and social advancement of all peoples,
HAVE RESOLVED TO COMBINE OUR EFFORTS TO ACCOMPLISH THESE AIMS Accordingly, our respective Governments, through representatives assembled in the city of San Francisco, who have exhibited their full powers found to be in good and due form, have agreed to the present Charter of the United Nations and do hereby establish an international organization to be known as the United Nations.
我聯(lián)合國人民同茲決心欲免后世再遭今代人類兩度身歷慘不堪言之戰(zhàn)禍,重申基本人權(quán),人格尊嚴(yán)與價(jià)值,以及男女與大小各國平等權(quán)利之信念,創(chuàng)造適當(dāng)環(huán)境,俾克維持正義,尊重由條約與國際法其他淵源而起之義務(wù),久而弗懈,促成大自由中之社會(huì)進(jìn)步及較善之民生, 并為達(dá)此目的力行容恕,彼此以善鄰之道,和睦相處,集中力量,以維持國際和平及安全,
接受原則,確立方法,以保證非為公共利益,不得使用武力,運(yùn)用國際機(jī)構(gòu),以促成全球人民經(jīng)濟(jì)及社會(huì)之進(jìn)展, 用是發(fā)憤立志,務(wù)當(dāng)同心協(xié)力,以竟厥功。
爰由我各本國政府,經(jīng)齊集金山市之代表各將所奉全權(quán)證書,互相校閱,均屬妥善,議定本聯(lián)合國憲章,并設(shè)立國際組織,定名聯(lián)合國。
CHAPTER I PURPOSES AND PRINCIPLES第一章 宗旨及原則
Article 1 The Purposes of the United Nations are: 第一條聯(lián)合國之宗旨為:
1. To maintain international peace and security, and to that end: to take effective collective measures for the prevention and removal of threats to the peace, and for the suppression of acts of aggression or other breaches of the peace, and to bring about by peaceful means, and in conformity with the principles of justice and international law, adjustment or settlement of international disputes or situations which might lead to a breach of the peace;
一、維持國際和平及安全;并為此目的:采取有效集體辦法,以防止且消除對(duì)于和平之威脅,制止侵略行為或其他和平之破壞;并以和平方法且依正義及國際法之原則,調(diào)整或解決足以破壞和平之國際爭(zhēng)端或情勢(shì)。
2. To develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, and to take other appropriate measures to strengthen universal peace;
3. To achieve international co-operation in solving international problems of an economic, social, cultural, or humanitarian character, and in promoting and encouraging respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion; and
4. To be a centre for harmonizing the actions of nations in the attainment of these common ends.
二、發(fā)展國際間以尊重人民平等權(quán)利及自決原則為根據(jù)之友好關(guān)系,并采取其他適當(dāng)辦法,以增強(qiáng)普遍和平。
三、促成國際合作,以解決國際間屬于經(jīng)濟(jì)、社會(huì)、文化及人類福利性質(zhì)之國際問題,且不分種族、性別、語言或宗教,增進(jìn)并激勵(lì)對(duì)于全體人類之人權(quán)及基本自由之尊重。
四、構(gòu)成一協(xié)調(diào)各國行動(dòng)之中心,以達(dá)成上述共同目的。
Article 2 The Organization and its Members, in pursuit of the Purposes stated in Article 1, shall act in accordance with the following Principles.
1. The Organization is based on the principle of the sovereign equality of all its Members.
2. All Members, in order to ensure to all of them the rights and benefits resulting from membership, shall fulfill in good faith the obligations assumed by them in accordance with the present Charter.
第二條 為求實(shí)現(xiàn)第一條所述各宗旨起見,本組織及其會(huì)員國應(yīng)遵行下列原則:
一、本組織系基于備會(huì)員國主權(quán)平等之原則。
二、各會(huì)員國應(yīng)一秉善意,履行其依本憲章所擔(dān)負(fù)之義務(wù),以保證全體會(huì)員國由加入本組織而發(fā)生之權(quán)益。
3. All Members shall settle their international disputes by peaceful means in such a manner that international peace and security, and justice, are not endangered.
4. All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.
5. All Members shall give the United Nations every assistance in any action it takes in accordance with the present Charter, and shall refrain from giving assistance to any state against which the United Nations is taking preventive or enforcement action.
三、各會(huì)員國應(yīng)以和平方法解決其國際爭(zhēng)端,俾免危及國際和平、安全及正義。
四、各會(huì)員國在其國際關(guān)系上不得使用威脅或武力,或以與聯(lián)合國宗旨不符之任何其他方法,侵害任何會(huì)員國或國家之領(lǐng)土完整或政治獨(dú)立。
五、各會(huì)員國對(duì)于聯(lián)合國依本憲章規(guī)定而采取之行動(dòng),應(yīng)盡力予以協(xié)助,聯(lián)合國對(duì)于任何國家正在采取防止或執(zhí)行行動(dòng)時(shí),各會(huì)員國對(duì)該國不得給予協(xié)助。
6. The Organization shall ensure that states which are not Members of the United Nations act in accordance with these Principles so far as may be necessary for the maintenance of international peace and security.
7. Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state or shall require the Members to submit such matters to settlement under the present Charter; but this principle shall not prejudice the application of enforcement measures under Chapter Vll.
六、本組織在維持國際和平及安全之必要范圍內(nèi),應(yīng)保證非聯(lián)合國會(huì)員國遵行上述原則。
七、本憲章不得認(rèn)為授權(quán)聯(lián)合國干涉在本質(zhì)上屬于任何國家國內(nèi)管轄之事件,且并不要求會(huì)員國將該項(xiàng)事件依本憲章提請(qǐng)解決;但此項(xiàng)原則不妨礙第七章內(nèi)執(zhí)行辦法之適用。
CHAPTER II MEMBERSHIP第二章 會(huì)員
Article 3 The original Members of the United Nations shall be the states which, having participated in the United Nations Conference on International Organization at San Francisco, or having previously signed the Declaration by United Nations of 1 January 1942, sign the present Charter and ratify it in accordance with Article 110.
第三條 凡曾經(jīng)參加金山聯(lián)合國國際組織會(huì)議或前此曾簽字于一九四二年一月一日聯(lián)合國宣言之國家,簽訂本憲章,且依憲章第一百一十條規(guī)定而予以批準(zhǔn)者,均為聯(lián)合國之創(chuàng)始會(huì)員國。
Article 4第四條
1. Membership in the United Nations is open to all other peace-loving states which accept the obligations contained in the present Charter and, in the judgment of the Organization, are able and willing to carry out these obligations.
2. The admission of any such state to membership in the United Nations will be effected by a decision of the General Assembly upon the recommendation of the Security Council.
一、凡其他愛好和平之國家,接受本憲章所載之義務(wù),經(jīng)本組織認(rèn)為確能并愿意履行該項(xiàng)義務(wù)者,得為聯(lián)合國會(huì)員國。
二、準(zhǔn)許上述國家為聯(lián)合國會(huì)員國,將由大會(huì)經(jīng)安全理事會(huì)之推薦以決議行之。
Article 5第五條
A Member of the United Nations against which preventive or enforcement action has been taken by the Security Council may be suspended from the exercise of the rights and privileges of membership by the General Assembly upon the recommendation of the Security Council. The exercise of these rights and privileges may be restored by the Security Council.
聯(lián)合國會(huì)員國,業(yè)經(jīng)安全理事會(huì)對(duì)其采取防止或執(zhí)行行動(dòng)者,大會(huì)經(jīng)安全理事會(huì)之建議,得停止其會(huì)員權(quán)利及特權(quán)之行使。此項(xiàng)權(quán)利及特權(quán)之行使,得由安全理事會(huì)恢復(fù)之。
Article 6第六條
A Member of the United Nations which has persistently violated the Principles contained in the present Charter may be expelled from the Organization by the General Assembly upon the recommendation of the Security Council.
聯(lián)合國之會(huì)員國中,有屢次違犯本憲章所載之原則者,大會(huì)經(jīng)安全理事會(huì)之建議,得將其由本組織除名。
CHAPTER III ORGANS第三章 機(jī)關(guān)
第七條Article 7
1. There are established as the principal organs of the United Nations: a General Assembly, a Security Council, an Economic and Social Council, a Trusteeship Council, an International Court of Justice, and a Secretariat.
茲設(shè)聯(lián)合國之主要機(jī)關(guān)如下:大會(huì) 安全理事會(huì) 經(jīng)濟(jì)及社會(huì)理事會(huì) 托管理事會(huì) 國際法院及秘書處。
2. Such subsidiary organs as may be found necessary may be established in accordance with the present Charter.
聯(lián)合國得依本憲章設(shè)立認(rèn)為必需之輔助機(jī)關(guān)。
Article 8第八條
The United Nations shall place no restrictions on the eligibility of men and women to participate in any capacity and under conditions of equality in its principal and subsidiary organs.
聯(lián)合國對(duì)于男女均得在其主要及輔助機(jī)關(guān)在平等條件之下,充任任何職務(wù),不得加以限制。
CHAPTER IV THE GENERAL ASSEMBLY COMPOSITION第四章 大會(huì)組織
Article 9第九條
1. The General Assembly shall consist of all the Members of the United Nations.
2. Each Member shall have not more than five representatives in the General Assembly.
一、大會(huì)由聯(lián)合國所有會(huì)員國組織之。
二、每一會(huì)員國在大會(huì)之代表,不得超過五人。
FUNCTIONS AND POWERS職權(quán)
Article 10第十條
The General Assembly may discuss any questions or any matters within the scope of the present Charter or relating to the powers and functions of any organs provided for in the present Charter, and, except as provided in Article 12, may make recommendations to the Members of the United Nationsor to the Security Council or to both on any such questions or matters.
大會(huì)得討論本憲章范圍內(nèi)之任何問題或事項(xiàng),或關(guān)于本憲章所規(guī)定任何機(jī)關(guān)之職權(quán);并除第十二條所規(guī)定外,得向聯(lián)合國會(huì)員國或安全理事會(huì)或兼向兩者,提出對(duì)各該問題或事項(xiàng)之建議。
Article 11第十一條
1. The General Assembly may consider the general principles of co-operation in the maintenance of international peace and security, including the principles governing disarmament and the regulation of armaments, and may make recommendations with regard to such principles to the Members or to the Security Council or to both.
2. The General Assembly may discuss any questions relating to the maintenance of international peace and security brought before it by any Member of the United Nations, or by the Security Council, or by a state which is not a Member of the United Nations in accordance with Article 35, paragraph 2, and, except as provided in Article 12, may make recommendations with regard to any such questions to the state or states concerned or to the Security Council or to both. Any such question on which action is necessary shall be referred to the Security Council by the General Assembly either before or after discussion.
一、大會(huì)得考慮關(guān)于維持國際和平及安全之合作之普通原則,包括軍縮及軍備管制之原則;并得向會(huì)員國或安全理事會(huì)或兼向兩者提出對(duì)于該項(xiàng)原則之建議。
二、大會(huì)得討論聯(lián)合國任何會(huì)員國或安全理事會(huì)或非聯(lián)合國會(huì)員國依第三十五條第二項(xiàng)之規(guī)定向大會(huì)所提關(guān)于維持國際和平及安全之任何問題;除第十二條所規(guī)定外,并得向會(huì)員國或安全理事會(huì)或兼向兩者提出對(duì)于各該項(xiàng)問題之建議。凡對(duì)于需要行動(dòng)之備該項(xiàng)問題,應(yīng)由大會(huì)于討論前或討診后提交安全理事會(huì)。
3. The General Assembly may call the attention of the Security Council to situations which are likely to endanger international peace and security.
4. The powers of the General Assembly set forth in this Article shall not limit the general scope of Article 10.
三、大會(huì)對(duì)于足以危及國際和平與安全之情勢(shì),得提請(qǐng)安全理事會(huì)注意。
四、本條所載之大會(huì)權(quán)力并不限制第十條之概括范圍。
Article 12第十二條
1. While the Security Council is exercising in respect of any dispute or situation the functions assigned to it in the present Charter, the General Assembly shall not make any recommendation with regard to that dispute or situation unless the Security Council so requests.
2. The Secretary-General, with the consent of the Security Council, shall notify the General Assembly at each session of any matters relative to the maintenance of international peace and security which are being dealt with by the Security Council and shall similarly notify the General Assembly, or the Members of the United Nations if the General Assembly is not in session, immediately the Security Council ceases to deal with suchmatters.
一、當(dāng)安全理事會(huì)對(duì)于任何爭(zhēng)端或情勢(shì),正在執(zhí)行本憲章所授予該會(huì)之職務(wù)時(shí),大會(huì)非經(jīng)安全理事會(huì)請(qǐng)求,對(duì)于該項(xiàng)爭(zhēng)端或情勢(shì),不得提出任何建議。
二、秘書長(zhǎng)經(jīng)安全理事會(huì)之同意,應(yīng)于大會(huì)每次會(huì)議時(shí),將安全理事會(huì)正在處理中關(guān)于維持國際和平及安全之任何事件,通知大會(huì);于安全理事會(huì)停止處理該項(xiàng)事件時(shí),亦應(yīng)立即通知大會(huì),或在大會(huì)閉會(huì)期內(nèi)通知聯(lián)合國會(huì)員國。
Article 13第十三條
1. The General Assembly shall initiate studies and make recommendations for the purpose of:
a. promoting international co-operation in the political field and encouraging the progressive development of international law and its codification;
b. promoting international co-operation in the economic, social, cultural,educational, and health fields, and assisting in the realization of human rights and fundamental freedoms for all without distinction as to race,sex, language, or religion.
一、大會(huì)應(yīng)發(fā)動(dòng)研究,并作成建議:
(子)以促進(jìn)政治上之國際合作,并提倡國際法之逐漸發(fā)展與編纂。
(丑)以促進(jìn)經(jīng)濟(jì)、社會(huì)、文化、教育及衛(wèi)生各部門之國際合作,且不分種族、性別、語言或宗教,助成全體人類之人權(quán)及基本自由之實(shí)現(xiàn)。
2. The further responsibilities, functions and powers of the General Assembly with respect to matters mentioned in paragraph 1 (b) above are set forth in Chapters IX and X.
二、大會(huì)關(guān)于本條第一項(xiàng)(丑)款所列事項(xiàng)之其他責(zé)任及職權(quán),于第九章及第十章中規(guī)定之。
Article 14第十四條
Subject to the provisions of Article 12, the General Assembly may recommend measures for the peaceful adjustment of any situation,regardless of origin, which it deems likely to impair the general welfare or friendly relations among nations, including situations resulting from a violation of the provisions of the present Charter setting forth the Purposes and Principles of the United Nations.
大會(huì)對(duì)于其所認(rèn)為足以妨害國際間公共福利或友好關(guān)系之任何情勢(shì),不論其起原如何,包括由違反本憲章所載聯(lián)合國之宗旨及原則而起之情勢(shì),得建議和平調(diào)整辦法,但以不違背第十二條之規(guī)定為限。
Article 15第十五條
1. The General Assembly shall receive and consider annual and special reports from the Security Council; these reports shall include an account of the measures that the Security Council has decided upon or taken to maintain international peace and security.
2. The General Assembly shall receive and consider reports from the other organs of the United Nations.
一、大會(huì)應(yīng)收受并審查安全理事會(huì)所送之常年及特別報(bào)告;該項(xiàng)報(bào)告應(yīng)載有安全理事會(huì)對(duì)于維持國際和平及安全所已決定或施行之辦法之陳述。
二、大會(huì)應(yīng)收受并審查聯(lián)合國其他機(jī)關(guān)所送之報(bào)告。
Article 16第十六條
The General Assembly shall perform such functions with respect to the international trusteeshipsystem as are assigned to it under Chapters XII and XIII, including the approval of the trusteeship agreements for areasnot designated as strategic.
大會(huì)應(yīng)執(zhí)行第十二章及第十三章所授予關(guān)于國際托管制度之職務(wù),包括關(guān)于非戰(zhàn)略防區(qū)托管協(xié)定之核準(zhǔn)。
Article 17第十七條
1. The General Assembly shallconsider and approve the budget of the Organization.
2. The expenses of the Organization shall be borne by the Members as apportioned by the General Assembly.
3. The General Assembly shall consider and approve any financial and budgetary arrangements with specialized agencies referred to in Article 57 and shall examine the administrative budgets of such specialized agencies with a view to making recommendations to the agencies concerned.
一、大會(huì)應(yīng)審核本組織之預(yù)算。
二、本組織之經(jīng)費(fèi)應(yīng)由各會(huì)員國依照大會(huì)分配限額擔(dān)負(fù)之。
三、大會(huì)應(yīng)審核經(jīng)與第五十七條所指各種專門機(jī)關(guān)訂定之任何財(cái)政及預(yù)算辦法,井應(yīng)審查該項(xiàng)專門機(jī)關(guān)之行政預(yù)算,以便向關(guān)系機(jī)關(guān)提出建議。
VOTING投票
Article 18第十八條
1. Each member of the General Assembly shall have one vote.
2. Decisions of the General Assembly on important questions shall be made by a two-thirds majority of the members present and voting. These questions shall include: recommendations with respect to the maintenance of international peace and security, the election of the non-permanent members of the Security Council, the election of the members of the Economic and Social Council, the election of members of the Trusteeship Council in accordance with paragraph 1 (c) of Article 86, the admission of new Members to the United Nations, the suspension of the rights and privileges of membership, the expulsion of Members, questions relating to the operation of the trusteeship system, and budgetary questions.
一、大會(huì)之每一會(huì)員國,應(yīng)有一個(gè)投票權(quán)。

3. Decisions on other questions, including the determination of additional categories of questions to be decided by a two-thirds majority, shall be made by a majority of the members present and voting.
三、關(guān)于其他問題之決議,包括另有何種事項(xiàng)應(yīng)以三分之二多數(shù)決定之問題,應(yīng)以到會(huì)及投票之會(huì)員國過半數(shù)決定之。
Article 19第十九條
A Member of the United Nations which is in arrears in the payment of its financial contributions to the Organization shall have no vote in the General Assembly if the amount of its arrears equals or exceeds the amount of the contributions due from it for the preceding two full years. The General Assembly may, nevertheless, permit such a Member to vote if it is satisfied that the failure to pay is due to conditions beyond the control of the Member.
凡拖欠本組織財(cái)政款項(xiàng)之會(huì)員國,其拖欠數(shù)目如等于或超過前兩年所應(yīng)繳納之?dāng)?shù)目時(shí),即喪失其在大會(huì)投票權(quán)。大會(huì)如認(rèn)拖欠原因,確由于該會(huì)員國無法控制之情形者,得準(zhǔn)許該會(huì)員國投票。
PROCEDURE程序
第二十條Article 20
The General Assembly shall meet in regular annual sessions and in such special sessions as occasion may require. Special sessions shall be convoked by the Secretary-General at the request of the Security Council or of a majority of the Members of the United Nations.
大會(huì)每年應(yīng)舉行常會(huì),并于必要時(shí),舉行特別會(huì)議。特別會(huì)議應(yīng)由秘書長(zhǎng)經(jīng)安全理事會(huì)或聯(lián)合國會(huì)員國過半數(shù)之請(qǐng)求召集之。
Article 21第二十一條
The General Assembly shall adopt its own rules of procedure. It shall elect its President for each session.
大會(huì)應(yīng)自行制定其議事規(guī)則。大會(huì)應(yīng)選舉每次會(huì)議之主席。
Article 22第二十二條
The General Assembly may establish such subsidiary organs as it deems necessary for the performance of its functions.
大會(huì)得設(shè)立其認(rèn)為于行使職務(wù)所必需之輔助機(jī)關(guān)。
CHAPTER V THE SECURITY COUNCIL第五章 安全理事會(huì)
Composition組織
Article 23第二十三條
1. The Security Council shall consist of fifteen Members of the United Nations. The Republic of China, France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland, and the United States of America shall be permanent members of the Security Council. The General Assembly shall elect ten other Members of the United Nations to be non-permanent members of the Security Council, due regard being specially paid, in the first instance to the contribution of Members of the United Nations to the maintenance of international peace and security and to the other purposes of the Organization, and also to equitable geographical distribution.
一、安全理事會(huì)以聯(lián)合國十五會(huì)員國組織之。中華民國、法蘭西、蘇維埃社會(huì)主義共和國聯(lián)盟、大不列顛及北愛爾蘭聯(lián)合王國及美利堅(jiān)合眾國應(yīng)為安全理事會(huì)常任理事國。大會(huì)應(yīng)選舉聯(lián)合國其他十會(huì)員國為安全理事會(huì)非常任理事國,選舉時(shí)首宜充分斟酌聯(lián)合國各會(huì)員國于維持國際和平與安全及本組織其余備宗旨上之貢獻(xiàn),并宜充分斟酌地域上之公勻分配。
2. The non-permanent members of the Security Council shall be elected for a term of two years. In the first election of the non-permanent members after the increase of the membership of the Security Council from eleven to fifteen, two of the four additional members shall be chosen for a term of one year. A retiring member shall not be eligible for immediate re-election.
3. Each member of the Security Council shall have one representative.
二、安全理事會(huì)非常任理事國任期定為二年。安全理事會(huì)理事國自十一國增至十五國后第一次選舉非任理事國時(shí),所增四國中兩國之任期應(yīng)為一年。任滿之理事國不得即行連選。
三、安全理事會(huì)每一理事國應(yīng)有代表一人。
FUNCTIONS AND POWERS職權(quán)
Article 24第二十四條
1. In order to ensure prompt and effective action by the United Nations,its Members confer on the Security Council primary responsibility for the maintenance of international peace and security, and agree that in carrying out its duties under this responsibility the Security Council acts on their behalf.
2. In discharging these duties the Security Council shall act in accordance with the Purposes and Principles of the United Nations. The specific powers granted to the Security Council for the discharge of these duties are laid down in Chapters VI, VII, VIII, and XII.
3. The Security Council shall submit annual and, when necessary, special reports to the General Assembly for its consideration.
一、為保證聯(lián)合國行動(dòng)迅速有效起見,各會(huì)員國將維持國際和平及安全之主要責(zé)任,授予安全理事會(huì),并同意安全理事會(huì)于履行此項(xiàng)責(zé)任下之職務(wù)時(shí),即系代表各會(huì)員國。
二、安全理事會(huì)于履行此項(xiàng)職務(wù)時(shí),應(yīng)遵照聯(lián)合國之宗旨及原則。為履行此項(xiàng)職務(wù)而授予安全理事會(huì)之特定權(quán)力,于本憲章第六章、第七章、第八章及第十二章內(nèi)規(guī)定之。
三、安全理事會(huì)應(yīng)將常年報(bào)告、并于必要時(shí)將特別報(bào)告,提送大會(huì)審查。
Article 25第二十五條
The Members of the United Nations agree to accept and carry out the decisions of the Security Council in accordance with the present Charter.
聯(lián)合國會(huì)員國同意依憲章之規(guī)定接受并履行安全理事會(huì)之決議。
Article 26第二十六條
In order to promote the establishment and maintenance of international peace and security with the least diversion for armaments of the world's human and economic resources, the Security Council shall be responsible for formulating, with the assistance of the Military Staff Committee referred to in Article 47, plans to be submitted to the Members of the United Nations for the establishment of a system for the regulation of armaments.
為促進(jìn)國際和平及安全之建立及維持,以盡量減少世界人力及經(jīng)濟(jì)資源之消耗于軍備起見,安全理事會(huì)借第四十七條所指之軍事參謀團(tuán)之協(xié)助,應(yīng)負(fù)責(zé)擬具方案,提交聯(lián)合國會(huì)員國,以建立軍備管制制度。
VOTING投票
Article 27第二十七條
1. Each member of the Security Council shall have one vote.
2. Decisions of the Security Council on procedural matters shall be made by an affirmative vote of nine members.
一、安全理事會(huì)每一理事國應(yīng)有一個(gè)投票權(quán)。
二、安全理事會(huì)關(guān)于程序事項(xiàng)之決議,應(yīng)以九理事國之可決票表決之。
3. Decisions of the Security Council on all other matters shall be made by an affirmative vote of nine members including the concurring votes of the permanent members; provided that, in decisions under Chapter VI, and under paragraph 3 of Article 52, a party to a dispute shall abstain from voting.
三、安全理事會(huì)對(duì)于其他一切事項(xiàng)之決議,應(yīng)以九理事國之可決票包括全體常任理事國之同意票表決之;但對(duì)于第六章及第五十二條第三項(xiàng)內(nèi)備事項(xiàng)之決議,爭(zhēng)端當(dāng)事國不得投票。
PROCEDURE程序
Article 28第二十八條
1. The Security Council shall be so organized as to be able to function continuously. Each member of the Security Council shall for this purpose be represented at all times at the seat of the Organization.
2. The Security Council shall hold periodic meetings at which each of its members may, if it so desires, be represented by a member of the government or by some other specially designated representative.
3. The Security Council may hold meetings at such places other than the seat of the Organization as in its judgment will best facilitate its work.
一、安全理事會(huì)之組織,應(yīng)以使其能繼續(xù)不斷行使職務(wù)為要件。為此目的,安全理事會(huì)之各理事國應(yīng)有常駐本組織會(huì)所之代表。
二、安全理事會(huì)應(yīng)舉行定期會(huì)議,每一理事國認(rèn)為合宜時(shí)得派政府大員或其他特別指定之代表出席。
三、在本組織會(huì)所以外,安全理事會(huì)得在認(rèn)為最能便利其工作之其他地點(diǎn)舉行會(huì)議。
Article 29第二十九條
The Security Council may establish such subsidiary organs as it deems necessary for the performance of its functions.
安全理事會(huì)得設(shè)立其認(rèn)為于行使職務(wù)所必需之輔助機(jī)關(guān)。
Article 30第三十條
The Security Council shall adopt its own rules of procedure, including the method of selecting its President.
安全理事會(huì)應(yīng)自行制定其議事規(guī)則,包括其推選主席之方法。
Article 31第三十一條
Any Member of the United Nations which is not a member of the Security Council may participate, without vote, in the discussion of any question brought before the Security Council whenever the latter considers that the interests of that Member are specially affected.
在安全理事會(huì)提出之任何問題,經(jīng)其認(rèn)為對(duì)于非安全理事會(huì)理事國之聯(lián)合國任何會(huì)員國之利益有特別關(guān)系時(shí),該會(huì)員國得參加討論,但無投票極。
Article 32第三十二條
Any Member of the United Nations which is not a member of the Security Council or any state which is not a Member of the United Nations, if it is a party to a dispute under consideration by the Security Council, shall be invited to participate, without vote, in the discussion relating to the dispute. The Security Council shall lay down such conditions as it deems just for the participation of a state which is not a Member of the United Nations.
聯(lián)合國會(huì)員國而非為安全理事會(huì)之理事國,或非聯(lián)合國會(huì)員國之國家,如于安全理事會(huì)考慮中之爭(zhēng)端為當(dāng)事國者,應(yīng)被邀參加關(guān)于該項(xiàng)爭(zhēng)端之討論,但無投票權(quán)。安全理事會(huì)應(yīng)規(guī)定其所認(rèn)為公平之條件,以便非聯(lián)合國會(huì)員國之國家參加。
CHAPTER VI PACIFIC SETTLEMENT OF DISPUTES第六章 爭(zhēng)端之和平解決
Article 33第三十三條
1. The parties to any dispute, the continuance of which is likely to endanger the maintenance of international peace and security, shall, first of all, seek a solution by negotiation, enquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements, or other peaceful means of their own choice.
2. The Security Council shall, when it deems necessary, call upon the parties to settle their dispute by such means.
一、任何爭(zhēng)端之當(dāng)事國,于爭(zhēng)端之繼續(xù)存在足以危及國際和平與安全之維持時(shí),應(yīng)盡先以談判、調(diào)查、調(diào)停、和解、公斷、司法解決、區(qū)域機(jī)關(guān)或區(qū)域辦法之利用,或各該國自行選擇之其他和平方法,求得解決。
二、安全理事會(huì)認(rèn)為必要時(shí),應(yīng)促請(qǐng)各當(dāng)事國以此項(xiàng)方法,解決其爭(zhēng)端。
Article 34第三十四條
The Security Council may investigate any dispute, or any situation which might lead to international friction or give rise to a dispute, in order to determine whether the continuance of the dispute or situation is likely to endanger the maintenance of international peace and security.
安全理事會(huì)得調(diào)查任何爭(zhēng)端或可能引起國際磨擦或惹起爭(zhēng)端之任何情勢(shì),以斷定該項(xiàng)爭(zhēng)端或情勢(shì)之繼續(xù)存在是否足以危及國際和平與安全之維持。
Article 35第三十五條
1. Any Member of the United Nations may bring any dispute, or any situation of the nature referred to in Article 34, to the attention of the Security Council or of the General Assembly.
2. A state which is not a Member of the United Nations may bring to the attention of the Security Council or of the General Assembly any dispute to which it is a party if it accepts in advance, for the purposes of the dispute, the obligations of pacific settlement provided in the present Charter.
3. The proceedings of the General Assembly in respect of matters brought to its attention under this Article will be subject to the provisions of Articles 11 and 12.
一、聯(lián)合國任何會(huì)員國得將屬于第三十四條所指之性質(zhì)之任何爭(zhēng)端或情勢(shì),提請(qǐng)安全理事會(huì)或大會(huì)注意。
二、非聯(lián)合國會(huì)員國之國家如為任何爭(zhēng)端之當(dāng)事國時(shí),經(jīng)預(yù)先聲明就該爭(zhēng)端而言接受本憲章所規(guī)定和平解決之義務(wù)后,得將該項(xiàng)爭(zhēng)端,提請(qǐng)大會(huì)或安全理事會(huì)注意。
三、大會(huì)關(guān)于按照本條所提請(qǐng)注意事項(xiàng)之進(jìn)行步驟,應(yīng)遵守第十一條及第十二條之規(guī)定。
Article 36第三十六條
1. The Security Council may, at any stage of a dispute of the nature referred to in Article 33 or of a situation of like nature, recommend appropriate procedures or methods of adjustment.
2. The Security Council should take into consideration any procedures for the settlement of the dispute which have already been adopted by the parties.
3. In making recommendations under this Article the Security Council should also take into consideration that legal disputes should as a general rule be referred by the parties to the International Court of Justice in accordance with the provisions of the Statute of the Court.
一、屬于第三十三條所指之性質(zhì)之爭(zhēng)端或相似之情勢(shì),安全理事會(huì)在任何階段,得建議適當(dāng)程序或調(diào)整方法。
二、安全理事會(huì)對(duì)于當(dāng)事國為解決爭(zhēng)端業(yè)經(jīng)采取之任何程序,理應(yīng)予以考慮。
三、安全理事會(huì)按照本條作成建議時(shí),同時(shí)理應(yīng)注意見具有法律性質(zhì)之爭(zhēng)端,在原則上,理應(yīng)由當(dāng)事國依國際法院規(guī)約之規(guī)定提交國際法院。
Article 37第三十七條
1. Should the parties to a dispute of the nature referred to in Article 33 fail to settle it by the means indicated in that Article, they shall refer it to the Security Council.
2. If the Security Council deems that the continuance of the dispute is in fact likely to endanger the maintenance of international peace and security, it shall decide whether to take action under Article 36 or to recommend such terms of settlement as it may consider appropriate.
一、屬于第三十三條所指之性質(zhì)之爭(zhēng)端,當(dāng)事國如未能依該條所示方法解決時(shí),應(yīng)將該項(xiàng)爭(zhēng)端提交安全理事會(huì)。
二、安全理事會(huì)如認(rèn)為該項(xiàng)爭(zhēng)端之繼續(xù)存在,在事實(shí)上足以危及國際和平與安全之維持時(shí),應(yīng)決定是否當(dāng)依第三十六條采取行動(dòng)或建議其所認(rèn)為適當(dāng)之解決條件。
Article 38第三十八條
Without prejudice to the provisions of Articles 33 to 37, the Security Council may, if all the parties to any dispute so request, make recommendations to the parties with a view to a pacific settlement of the dispute.
安全理事會(huì)如經(jīng)所有爭(zhēng)端當(dāng)事國之請(qǐng)求,得向各當(dāng)事國作成建議,以求爭(zhēng)端之和平解決,但以不妨礙第三十三條至第三十七條之規(guī)定為限。
CHAPTER VII ACTION WITH RESPECT TO THREATS TO THE PEACE, BREACHES OF THE PEACE, AND ACTS OF AGGRESSION
第七章 對(duì)于和平之威脅、和平之破壞及侵略行為之應(yīng)付辦法
Article 39第三十九條
The Security Council shall determine the existence of any threat to the peace, breach of the peace, or act of aggression and shall make recommendations, or decide what measures shall be taken in accordance with Articles 41 and 42, to maintain or restore international peace and security.
安全理事會(huì)應(yīng)斷定任何和平之威脅、和平之破壞或侵略行為之是否存在,并應(yīng)作成建議或抉擇依第四十一條及第四十二條規(guī)定之辦法,以維持或恢復(fù)國際和平及安全。
Article 40第四十條
In order to prevent an aggravation of the situation, the Security Council may, before making the recommendations or deciding upon the measures provided for in Article 39, call upon the parties concerned to comply with such provisional measures as it deems necessary or desirable. Such provisional measures shall be without prejudice to the rights, claims, or position of the parties concerned. The Security Council shall duly take account of failure to comply with such provisional measures.
為防止情勢(shì)之惡化,安全理事會(huì)在依第三十九條規(guī)定作成建議或決定辦法以前,得促請(qǐng)關(guān)系當(dāng)事國遵行安全理事會(huì)所認(rèn)為必要或合宜之臨時(shí)辦法。此項(xiàng)臨時(shí)辦法并不妨礙關(guān)系當(dāng)事國之權(quán)利、要求或立場(chǎng)。安全理事會(huì)對(duì)于不遵行此項(xiàng)臨時(shí)辦法之情形,應(yīng)予適當(dāng)注意。
Article 41第四十一條
The Security Council may decide what measures not involving the use of armed force are to be employed to give effect to its decisions, and it may call upon the Members of the United Nations to apply such measures. These may include complete or partial interruption of economic relations and of rail, sea, air, postal, telegraphic, radio, and other means of communication, and the severance of diplomatic relations.
安全理事會(huì)得決定所應(yīng)采武力以外之辦法,以實(shí)施其決議,并得促請(qǐng)聯(lián)合國會(huì)員國執(zhí)行此項(xiàng)辦法。此項(xiàng)辦法得包括經(jīng)濟(jì)關(guān)系、鐵路、海運(yùn)、航空、郵、電、無線電及其他交通工具之局部或全部停止,以及外交關(guān)系之?dāng)嘟^。
Article 42第四十二條
Should the Security Council consider that measures provided for in Article 41 would be inadequate or have proved to be inadequate, it may take such action by air, sea, or land forces as may be necessary to maintain or restore international peace and security. Such action may include demonstrations, blockade, and other operations by air, sea, or land forces of Members of the United Nations.
安全理事會(huì)如認(rèn)第四十一條所規(guī)定之辦法為不足或已經(jīng)證明為不足時(shí),得采取必要之空海陸軍行動(dòng),以維持或恢復(fù)國際和平及安全。此項(xiàng)行動(dòng)得包括聯(lián)合國會(huì)員國之空海陸軍示威、封鎖及其他軍事舉動(dòng)。
Article 43第四十三條
1. All Members of the United Nations, in order to contribute to the maintenance of international peace and security, undertake to make available to the Security Council,on its call and in accordance with a special agreement or agreements, armed forces, assistance, and facilities, including rights of passage, necessary for the purpose of maintaining international peace and security.
2. Such agreement or agreements shall govern the numbers and types of forces, their degree of readiness and general location, and the nature of the facilities and assistance to be provided.
3. The agreement or agreements shall be negotiated as soon as possible on the initiative of the Security Council. They shall be concluded between the Security Council and Members or between the Security Council and groups of Members and shall be subject to ratification by the signatory states in accordance with their respective constitutional processes.
一、聯(lián)合國各會(huì)員國為求對(duì)于維持國際和平及安全有所貢獻(xiàn)起見,擔(dān)任于安全理事會(huì)發(fā)令時(shí),并依特別協(xié)定,供給為維持國際和平及安全所必需之軍隊(duì)、協(xié)助及便利,包括過境權(quán)。
二、此項(xiàng)特別協(xié)定應(yīng)規(guī)定軍隊(duì)之?dāng)?shù)目及種類,其準(zhǔn)備程度及一般駐扎地點(diǎn),以及所供便利及協(xié)助之性質(zhì)。
三、此項(xiàng)特別協(xié)定應(yīng)以安全理事會(huì)之主動(dòng),盡速議訂。此項(xiàng)協(xié)定應(yīng)由安全理事會(huì)與會(huì)員國或由安全理事會(huì)與若干會(huì)員國之集團(tuán)締結(jié)之,并由簽字國各依其憲法程序批準(zhǔn)之。
Article 44第四十四條
When the Security Council has decided to use force it shall, before calling upon a Member not represented on it to provide armed forces in fulfilment of the obligations assumed under Article 43, invite that Member, if the Member so desires, to participate in the decisions of the Security Council concerning the employment of contingents of that Member's armed forces.
安全理事會(huì)決定使用武力時(shí),于要求非安全理事會(huì)會(huì)員國依第四十三條供給軍隊(duì)以履行其義務(wù)之前,如經(jīng)該會(huì)員國請(qǐng)求,應(yīng)請(qǐng)其遣派代表,參加安全理事會(huì)關(guān)于使用其軍事部隊(duì)之決議。
Article 45第四十五條
In order to enable the United Nations to take urgent military measures, Members shall hold immediately available national air-force contingents for combined international enforcement action. The strength and degree of readiness of these contingents and plans for their combined action shall be determined within the limits laid down in the special agreement or agreements referred to in Article 43, by the Security Council with the assistance of the Military Staff Committee.
為使聯(lián)合國能采取緊急軍事辦法起見,會(huì)員國應(yīng)將其本國空軍部隊(duì)為國際共同執(zhí)行行動(dòng)隨時(shí)供給調(diào)遣。此項(xiàng)部隊(duì)之實(shí)力與準(zhǔn)備之程度,及其共同行動(dòng)之計(jì)劃,應(yīng)由安全理事會(huì)以軍事參謀團(tuán)之協(xié)助,在第四十三條所指之特別協(xié)定范圍內(nèi)決定之。
Article 46第四十六條
Plans for the application of armed force shall be made by the Security Council with the assistance of the Military Staff Committee.
武力使用之計(jì)劃應(yīng)由安全理事會(huì)以軍事參謀團(tuán)之協(xié)助決定之。
Article 47第四十七條
1. There shall be established a Military Staff Committee to advise and assist the Security Council on all questions relating to the Security Council's military requirements for the maintenance of international peace and security, the employment and command of forces placed at its disposal, the regulation of armaments, and possible disarmament.
2. The Military Staff Committee shall consist of the Chiefs of Staff of the permanent members of the Security Council or their representatives. Any Member of the United Nations not permanently represented on the Committee shall be invited by the Committee to be associated with it when the efficient discharge of the Committee's responsibilities requires the participation of that Member in its work.
一、茲設(shè)立軍事參謀團(tuán),以便對(duì)于安全理事會(huì)維持國際和平及安全之軍事需要問題,對(duì)于受該會(huì)所支配軍隊(duì)之使用及統(tǒng)率問題,對(duì)于軍備之管制及可能之軍縮問題,向該會(huì)貢獻(xiàn)意見并予以協(xié)助。
二、軍事參謀團(tuán)應(yīng)由安全理事會(huì)各常任理事國之參謀總長(zhǎng)或其代表組織之。聯(lián)合國任何會(huì)員國在該團(tuán)未有常任代表者,如于該團(tuán)責(zé)任之履行在效率上必需該國參加其工作時(shí),應(yīng)由該團(tuán)邀請(qǐng)參加。
3. The Military Staff Committee shall be responsible under the Security Council for the strategic direction of any armed forces placed at the disposal of the Security Council. Questions relating to the command of such forces shall be worked out subsequently.
4. The Military Staff Committee, with the authorization of the Security Council and after consultation with appropriate regional agencies, may establish regional sub-committees.
三、軍事參謀團(tuán)在安全理事會(huì)權(quán)力之下,對(duì)于受該會(huì)所支配之任何軍隊(duì),負(fù)戰(zhàn)略上之指揮責(zé)任;關(guān)于該項(xiàng)軍隊(duì)之統(tǒng)率問題,應(yīng)待以后處理。
四、軍事參謀團(tuán),經(jīng)安全理事會(huì)之授權(quán),并與區(qū)域內(nèi)有關(guān)機(jī)關(guān)商議后、得設(shè)立區(qū)域分團(tuán)。
Article 48第四十八條
1. The action required to carry out the decisions of the Security Council for the maintenance of international peace and security shall be taken by all the Members of the United Nations or by some of them, as the Security Council may determine.
2. Such decisions shall be carried out by the Members of the United Nations directly and through their action in the appropriate international agencies of which they remembers.
一、執(zhí)行安全理事會(huì)為維持國際和平及安全之決議所必要之行動(dòng),應(yīng)由聯(lián)合國全體會(huì)員國或由若干會(huì)員國擔(dān)任之,一依安全理事會(huì)之決定。
二、此頃決議應(yīng)由聯(lián)合國會(huì)員國以其直接行動(dòng)及經(jīng)其加入為會(huì)員之有關(guān)國際機(jī)關(guān)之行動(dòng)履行之。
Article 49第四十九條
The Members of the United Nations shall join in affording mutual assistance in carrying out the measures decided upon by the Security Council.
聯(lián)合國會(huì)員國應(yīng)通力合作,彼此協(xié)助,以執(zhí)行安全理事會(huì)所決定之辦法。
Article 50第五十條
If preventive or enforcement measures against any state are taken by the Security Council, any other state, whether a Member of the United Nations or not, which finds itself confronted with special economic problems arising from the carrying out of those measures shall have the right to consult the Security Council with regard to a solution of those problems.
安全理事會(huì)對(duì)于任何國家采取防止或執(zhí)行辦法時(shí),其他國家,不論其是否為聯(lián)合國會(huì)員國,遇有因此項(xiàng)辦法之執(zhí)行而引起之特殊經(jīng)濟(jì)問題者,應(yīng)有權(quán)與安全理事會(huì)會(huì)商解決此項(xiàng)問題。
Article 51第五十一條
Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defence shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.
聯(lián)合國任何會(huì)員國受武力攻擊時(shí),在安全理事會(huì)采取必要辦法,以維持國際和平及安全以前,本憲章不得認(rèn)為禁止行使單獨(dú)或集體自衛(wèi)之自然權(quán)利。會(huì)員國因行使此項(xiàng)自衛(wèi)權(quán)而采取之辦法,應(yīng)立向安全理事會(huì)報(bào)告,此項(xiàng)辦法于任何方面不得影響該會(huì)按照本憲章隨時(shí)采取其所認(rèn)為必要行動(dòng)之權(quán)責(zé),以維持或恢復(fù)國際和平及安全。
CHAPTER VIII REGIONAL ARRANGEMENTS第八章 區(qū)域辦法
Article 52第五十二條
1. Nothing in the present Charter precludes the existence of regional arrangements or agencies for dealing with such matters relating to the maintenance of international peace and security as are appropriate for regional action provided that such arrangements or agencies and their activities are consistent with the Purposes and Principles of the United Nations.
2. The Members of the United Nations entering into such arrangements or constituting such agencies shall make every effort to achieve pacific settlement of local disputes through such regional arrangements or by such regional agencies before referring them to the Security Council.
3. The Security Council shall encourage the development of pacific settlement of local disputes through such regional arrangements or by such regional agencies either on the initiative of the states concerned or by reference from the Security Council.
4. This Article in no way impairs the application of Articles 34 and 35.
一、本憲章不得認(rèn)為排除區(qū)域辦法或區(qū)域機(jī)關(guān)、用以應(yīng)付關(guān)于維持國際和平及安全而宜于區(qū)域行動(dòng)之事件者;但以此項(xiàng)辦法或機(jī)關(guān)及其工作與聯(lián)合國之宗旨及原則符合者為限。
二、締結(jié)此項(xiàng)辦法或設(shè)立此項(xiàng)機(jī)關(guān)之聯(lián)合國會(huì)員國,將地方爭(zhēng)端提交安全理事會(huì)以前,應(yīng)依該項(xiàng)區(qū)域辦法,或由該項(xiàng)區(qū)域機(jī)關(guān),力求和平解決。
三、安全理事會(huì)對(duì)于依區(qū)域辦法或由區(qū)域機(jī)關(guān)而求地方爭(zhēng)端之和平解決,不論其系由關(guān)系國主動(dòng),或由安全理事會(huì)提交者,應(yīng)鼓勵(lì)其發(fā)展。
四、本條絕不妨礙第三十四條及第三十五條之適用。
