CONTRACT FOR LEASING OF CRANE EQUIPMENT

　　起重機(jī)設(shè)備租賃合同

　　The contract is made on between China ABC Company (Hereinafter called the Contractor) as one Party and Magellan Services (Hereinafter called the Supplier) as the other Party.

　　Whereas the Contractor desires to lease and the Supplier desires to rent out the following equipment for the project known as Land Reclamation Works at .

　　The Contractor and the Supplier agree as follows:

　　1. Description 設(shè)備基本情況

　　Description: 100t Crawler Crane with Operator, Brand: American Hoist 7260, Boom120′Long, Main Hook 25T, Serial Number GS18930.

　　帶操作人員的100噸履帶起重機(jī)，型號(hào)為American Hoist 7260，臂長120英尺，主吊鉤25噸，設(shè)備系列號(hào)GS18930。

　　The above equipment will be called the Equipment hereinafter.

　　2. Leasing Period 租賃期限

　　2.1 The leasing commencement date for the crawler crane shall be .

　　2.2 The leasing period shall be decided by the Contractor subject to his requirement and at his sole discretion. The leasing period excludes the time for mobilization and demobilization of the Equipment. Dhs.(阿聯(lián)酋貨幣)15,000.00 for mobilization will be paid by the Contractor and the demobilization fee will be paid by the Supplier.

　　2.3 The Contract shall inform the Supplier 14 days in advance of the expiry date of the Contract.

　　3. Price and Payment 價(jià)格與支付

　　3.1 Price

　　Description: 100t Crawler Crane with Operator Monthly Hire Rate (Dhs.): 62,400.00

　　The unit price is based on 10 net working hours (exclusive of lunch break) per day, 26 net working days per month (260 net working hours). Overtime will be charged on pro rata basis. In case of the Equipment breakdown during the working hours, deductions shall be made pro rata.

　　3.2 In case of the Equipment works less than the minimum hours or 10 hours per day due to non-availability of the work, the minimum hours as agreed will be applicable.

　　3.3 Payment

　　The payment shall be made monthly. At the beginning of every month, the Supplier should submit to the Contractor the payment application for the previous month’s hire supported by the time records certified by the Constructor’s engineer.

　　The Contractor shall pay to the Supplier the certified amount within 15 days after receiving the Supplier’s correct application.

　　4. Contractor’s Obligations 租賃方的責(zé)任

　　4.1 The Contractor shall provide the diesel.

　　4.2 The Contractor shall provide on site accommodation for the Supplier’s operator.

　　4.3 Security passes or permissions, if required, shall be arranged by the Contractor.

　　4.4 Any damage resulting from misuse or abuse of the Equipment by the Contractor shall be repaired by the Contractor.

　　4.5 Supervision at site shall be the Contractor’s responsibility.

　　5. Supplier’s Obligations 出租方的責(zé)任

　　5.1 The Supplier shall be responsible for the maintenance and repair of the Equipment and provide all required consumables at his own cost except as otherwise stated in Sub-Clauses 4.1 and 4.4.

　　5.2 If the Supplier’s operator does not work satisfactorily or his skill is lower than the local operator’s level, which is decided by the Contractor at his own discretion, the Contractor has the right to request the Supplier to replace him with an experienced and qualified one within the time stipulated by the Contractor.

　　5.3 The Supplier’s operator shall strictly comply with the Contractor’s instructions. If not, the Contractor may require the Supplier to replace the operator at any time.

　　5.4 The Supplier’s Equipment shall not be demobilized without approval by the Contractor.

　　5.5. The Supplier’s Equipment shall be in good conditions.

　　5.6 The Supplier’s Equipment shall be instructed by the Supplier and shall possess all the required certifications like Equipment Registration etc.

　　5.7 The Supplier’s Operator shall be insured by the Supplier and shall possess all the required certificates like Operator’s License.

　　6. Termination 合同終止

　　In case the Equipment can not meet the Contractor’s requirements, the contractor has the right to terminate this Contract without any compensation to the Supplier.

　　In witness whereof the Parties hereto have caused this Agreement to be executed the day and year first before written in accordance with the laws of the UAE.
