  The terms and conditions of use stated below shall apply to all customers who purchase products on this Site managed by NTT Resonant Inc. ("the Company"). Before placing an order, please read the terms and conditions carefully as they apply to all products purchased on this Site. The Company reserves the right, at its sole and exclusive discretion, to change, alter, modify, add, and/or remove any part of the terms and conditions at any time without any prior notice. The customer hereby agrees to be bound by any revisions to the terms and conditions from the published revision date. Further the Company in addition to the terms and conditions reserves the right to add further terms and conditions for each product added to this Site.

  1. Formation of Sale and Purchase Agreement關(guān)于本買賣契約之成立

  (1) The customer may place an order by entering the required fields on the order form on this Site ("the Order Form") and clicking on the purchase button. The Company where it approves the customer's order will send by e-mail an order approval notification ("Order Acceptance E-mail") to the e-mail address on the Order Form. At the time the customer receives this e-mail, a sale and purchase agreement in respect of the ordered product ("Purchase Agreement") shall be deemed to have been entered into between the Company and the customer. The Order Acceptance E-mail shall be deemed to have been received within the period reasonably expected for transmission of that e-mail.

  (2) Ordering of products under an alias, assumed name or under any name other than that of the customer or for the purpose of on-sale, resale or similar purpose ("an Illegitimate Order") is prohibited. Where the Company deems an order to be an Illegitimate Order, the Company may render the concerned sale and Purchase Agreement null and void.

  )禁止以別名、假名及客戶本人名字以外的其它名義訂購及以轉(zhuǎn)賣、轉(zhuǎn)售或其它類似目的進行商品訂購(以下稱為「不當訂購」)。經(jīng)查明有不當訂購之情形者,本公司得視同買賣契約無效。

  (3) If any disclosures made within this Site are incorrect, mistaken in content, misleading or false, the concerned sale and purchase agreement may be rendered null and void. Further mistaken disclosures include but are not limited to mistakes in product price, product name or product specifications posted on this Site.

  2. Returns and Exchanges關(guān)于退貨與更換

  (1) NO RETURNS OR EXCHANGES OF ANY PRODUCT PURCHASED SHALL BE MADE FOR ANY REASON WHATSOEVER.

  (2) Notwithstanding the preceding paragraph, the Company shall accept returns or exchanges of the product by the customer's choice where the customer finds that the product delivered from the Company is different to the one ordered, and contacts the Company within thirty (30) days ("acceptance period") from the date of delivery. Return shipping cost shall be borne by the Company. Accordingly the returned product should be marked cash on delivery (COD). The Company shall provide a refund (in Japanese yen) or provide a replacement product after confirming returned product is in mint condition without any damage. WHERE THE CUSTOMER CONTACTS THE COMPANY FOUR (4) DAYS OR MORE AFTER DELIVERY, THE COMPANY SHALL UNDER NO CIRCUMSTANCES WHATSOEVER REFUND THE PRODUCT PURCHASE PRICE OR REPLACE THE PRODUCT.

  無論前項規(guī)定為何,本公司寄送之商品與客戶訂購商品不同時,僅限于自該商品送達日起算三十(30)天內(nèi)(以下稱為「接受期限」)聯(lián)絡本公司者,可依客戶選擇予以退貨或更換商品。遇此情形,本公司將負擔退還商品所產(chǎn)生的運費,請以貨到付款的方式將該項商品寄回。本公司收到退貨并確認商品完好無損后,將辦理退款(日元)或寄送替代品。無論任何情況下,自收到商品后超過四(4)天之后聯(lián)絡本公司者,本公司恕不接受任何商品的退換貨。

  (3) If a product fails to work out of the package, the customer will contact the manufacturer first. Notwithstanding the provisions of the preceding paragraphs, if the manufacturer agrees, the company may accept returns or exchanges of the product even after the acceptance period.

  如有商品拆封后無法正常使用的,請先聯(lián)絡制造廠商。無論前項規(guī)定為何,于制造廠商同意時,本公司將接受超過接受期限的商品退貨或更換。

  3. Order Cancellation, Change or Refund關(guān)于取消訂單、變更訂單與退款

  (1) IF AN ORDER HAS BEEN PLACED BY CLICKING ON THE PURCHASE BUTTON, UNLESS THE COMPANY DEEMS THAT SPECIAL CIRCUMSTANCES APPLY, THE CUSTOMER MAY UNDER NO CIRCUMSTANCES WHATSOEVER CANCEL THE ORDER, CHANGE ITS CONTENTS OR CLAIM A REFUND.

  (2) THE CUSTOMER MAY NOT CANCEL THE ORDER, CHANGE ITS CONTENTS OR CLAIM A REFUND WHEN THE PRODUCT IS NOT DELIVERD ON THE CUSTOMER'S PREFERRED DELIVERLY DATE OR DURING THE CUSTOMER'S PREFERRED HOURS OF DELIVERY FOR REASONS NOT ATTRIBUTABLE TO THE COMPANY.

  (1)請注意按下訂購按鈕送出訂單后,除本公司特別認可之情況外,任何情況下客戶均不得取消訂單、變更訂單內(nèi)容及要求退款。

  (2)請注意因不可歸責于本公司之事由,客戶無法于希望的領取日及希望領取時段領取商品時,一概不接受取消訂單、變更訂單內(nèi)容及退款。

  4. Product Shipping and Receipt of Goods關(guān)于商品之寄送及領取

  (1) Product (including replacement product) shall be shipped within Japan only.

  (2) If the customer desires to receive the product at a hotel or other lodging facility, the customer must check in advance whether this is acceptable with the lodging establishment staff. IF THE CUSTOMER DOES NOT RECEIVE THE PRODUCT BECAUSE A MEMBER OF THE LODGING FACILITY'S STAFF HAS REFUSED TO ACCEPT IT ON THE CUSTOMER'S BEHALF, THE COMPANY SHALL BE UNDER NO LIABILITY WHATSOEVER.

  (1)提供之商品寄送(含替代品的寄送)區(qū)域僅限于日本國內(nèi)。

  (2)希望于下塌飯店等住宿設施領取商品時,請事先向該住宿設施確認領取商品的相關(guān)事項。如有該住宿設施拒絕為客戶領取商品,以致客戶無法領取商品時,本公司一概不負責任。

  (3) The Company may ask for presentation of official certification of personal identification (passport, etc.) for handing over the product. If the "Recipient Name" entered into the Order Form at the time of purchase does not match the name on the official personal identification presented, the product cannot be handed over. If an airport post office or lodging establishment is designated as the delivery location for the product, the product may be received upon presentation of such official personal identification to a staff member of that post office or lodging establishment. If the designated "Recipient Address" is a location other than an airport post office or lodging establishment, the product may be delivered upon presentation of official personal identification to the delivery person. The Company at the time of handover of the product will confirm the identity of the customer. However the Company is under no obligation to ensure that the airport post office, lodging establishment staff or delivery person confirms the identity of the customer. THE PERSON THAT THE PRODUCT IS DELIVERED TO SHALL BE DEEMED TO BE THE CUSTOMER WHO PLACED THE ORDER AND THE COMPANY SHALL BE UNDER NO LIABILITY WHATSOEVER TO THE CUSTOMER OR ANY THIRD PARTY FOR ANY DAMAGE ARISING AS A RESULT OF FAILURE TO CONFIRM THE IDENTITY OF THE RECIPIENT.

  領取商品時本公司可要求出示官方身分證明文件(護照等)。訂購商品時填寫于訂購表格的「領取人姓名」與官方身分證明文件上記載的姓名如有不符,恕無法遞交商品,敬請見諒。將機場內(nèi)郵局或飯店等住宿設施指定為商品寄送處時,請將身分證明文件出示于該機場內(nèi)郵局或飯店工作人員后,再領取商品。指定機場內(nèi)郵局或飯店等住宿設施以外的地點為寄送處時,請將官方身分證明文件出示于寄送業(yè)者后,再領取商品。本公司在遞交商品時對客戶的身份進行確認。但本公司不對機場內(nèi)郵局或飯店等住宿設施的工作人員或寄送業(yè)者對客戶的身份進行確認承擔任何責任。本公司視領取商品者為訂購商品的客戶本人,如有因未進行領取商品賬者的身分確認,對客戶或第三方造成損害的,本公司一概不負任何責任。

  5. Handling of Personal Information關(guān)于個人數(shù)據(jù)處理

  (1) A customer's personal information (including their use history on this Site; hereinafter read together) shall be appropriately handled in accordance with the Privacy Policy of the Company separately stated. If the customer when using this Site provides a third party's personal information as the recipient's address, the customer shall be responsible for informing that third party of the purpose of use of personal information stipulated in the terms and conditions of use and obtain the consent of that party to the provision to the Company of that party's personal information. Provided that a third party's personal information is used only within the scope stated in the terms and conditions of use, in the event of any claim by a third party concerning that use, the customer shall resolve that claim at the customer's own expense and the Company shall be under no liability whatsoever in respect of the same.

  (1) EXCEPT WHERE SPECIFICALLY STATED IN THE TERMS AND CONDITIONS OF USE, IN THE EVENT THAT ANY LEGAL ACTION IS COMMENCED BY A CUSTOMER FOR ANY DAMAGE ARISING AS A RESULT OF USE OF THIS SITE OR ANY PRODUCT PURCHASED ON THIS SITE (INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, COLLATERAL, PUNITIVE OR CONSEQUENTIAL DAMAGE, OPPORTUNITY LOSS, BUSINESS SHUTDOWN, DATA LOSS OR ANY OTHER FINANCIAL DAMAGE) THE COMPANY SHALL BE UNDER NO LIABILITY WHATSOEVER.

  (2) Where any part of the terms and conditions of use are found to be non-enforceable, the remainder shall remain in force and effect.

The Order Acceptance E-mail shall be deemed to have been received within the period reasonably expected for transmission of that e-mail.

2. Returns and Exchanges關(guān)于退貨與更換

(2) Notwithstanding the preceding paragraph, the Company shall accept returns or exchanges of the product by the customer's choice where the customer finds that the product delivered from the Company is different to the one ordered, and contacts the Company within thirty (30) days ("acceptance period") from the date of delivery. Return shipping cost shall be borne by the Company. Accordingly the returned product should be marked cash on delivery (COD). The Company shall provide a refund (in Japanese yen) or provide a replacement product after confirming returned product is in mint condition without any damage. WHERE THE CUSTOMER CONTACTS THE COMPANY FOUR (4) DAYS OR MORE AFTER DELIVERY, THE COMPANY SHALL UNDER NO CIRCUMSTANCES WHATSOEVER REFUND THE PRODUCT PURCHASE PRICE OR REPLACE THE PRODUCT.

(3) If a product fails to work out of the package, the customer will contact the manufacturer first. Notwithstanding the provisions of the preceding paragraphs, if the manufacturer agrees, the company may accept returns or exchanges of the product even after the acceptance period.

3. Order Cancellation, Change or Refund關(guān)于取消訂單、變更訂單與退款

(1) IF AN ORDER HAS BEEN PLACED BY CLICKING ON THE PURCHASE BUTTON, UNLESS THE COMPANY DEEMS THAT SPECIAL CIRCUMSTANCES APPLY, THE CUSTOMER MAY UNDER NO CIRCUMSTANCES WHATSOEVER CANCEL THE ORDER, CHANGE ITS CONTENTS OR CLAIM A REFUND.

(2) THE CUSTOMER MAY NOT CANCEL THE ORDER, CHANGE ITS CONTENTS OR CLAIM A REFUND WHEN THE PRODUCT IS NOT DELIVERD ON THE CUSTOMER'S PREFERRED DELIVERLY DATE OR DURING THE CUSTOMER'S PREFERRED HOURS OF DELIVERY FOR REASONS NOT ATTRIBUTABLE TO THE COMPANY.

4. Product Shipping and Receipt of Goods關(guān)于商品之寄送及領取

(1) Product (including replacement product) shall be shipped within Japan only.

(2) If the customer desires to receive the product at a hotel or other lodging facility, the customer must check in advance whether this is acceptable with the lodging establishment staff. IF THE CUSTOMER DOES NOT RECEIVE THE PRODUCT BECAUSE A MEMBER OF THE LODGING FACILITY'S STAFF HAS REFUSED TO ACCEPT IT ON THE CUSTOMER'S BEHALF, THE COMPANY SHALL BE UNDER NO LIABILITY WHATSOEVER.

(2)希望于下塌飯店等住宿設施領取商品時,請事先向該住宿設施確認領取商品的相關(guān)事項。如有該住宿設施拒絕為客戶領取商品,以致客戶無法領取商品時,本公司一概不負責任。

 

(3) The Company may ask for presentation of official certification of personal identification (passport, etc.) for handing over the product. If the "Recipient Name" entered into the Order Form at the time of purchase does not match the name on the official personal identification presented, the product cannot be handed over. If an airport post office or lodging establishment is designated as the delivery location for the product, the product may be received upon presentation of such official personal identification to a staff member of that post office or lodging establishment. If the designated "Recipient Address" is a location other than an airport post office or lodging establishment, the product may be delivered upon presentation of official personal identification to the delivery person. The Company at the time of handover of the product will confirm the identity of the customer. However the Company is under no obligation to ensure that the airport post office, lodging establishment staff or delivery person confirms the identity of the customer. THE PERSON THAT THE PRODUCT IS DELIVERED TO SHALL BE DEEMED TO BE THE CUSTOMER WHO PLACED THE ORDER AND THE COMPANY SHALL BE UNDER NO LIABILITY WHATSOEVER TO THE CUSTOMER OR ANY THIRD PARTY FOR ANY DAMAGE ARISING AS A RESULT OF FAILURE TO CONFIRM THE IDENTITY OF THE RECIPIENT.

領取商品時本公司可要求出示官方身分證明文件(護照等)。訂購商品時填寫于訂購表格的「領取人姓名」與官方身分證明文件上記載的姓名如有不符,恕無法遞交商品,敬請見諒。將機場內(nèi)郵局或飯店等住宿設施指定為商品寄送處時,請將身分證明文件出示于該機場內(nèi)郵局或飯店工作人員后,再領取商品。指定機場內(nèi)郵局或飯店等住宿設施以外的地點為寄送處時,請將官方身分證明文件出示于寄送業(yè)者后,再領取商品。本公司在遞交商品時對客戶的身份進行確認。但本公司不對機場內(nèi)郵局或飯店等住宿設施的工作人員或寄送業(yè)者對客戶的身份進行確認承擔任何責任。本公司視領取商品者為訂購商品的客戶本人,如有因未進行領取商品賬者的身分確認,對客戶或第三方造成損害的,本公司一概不負任何責任。

 

5. Handling of Personal Information關(guān)于個人數(shù)據(jù)處理

(1) A customer's personal information (including their use history on this Site; hereinafter read together) shall be appropriately handled in accordance with the Privacy Policy of the Company separately stated. If the customer when using this Site provides a third party's personal information as the recipient's address, the customer shall be responsible for informing that third party of the purpose of use of personal information stipulated in the terms and conditions of use and obtain the consent of that party to the provision to the Company of that party's personal information.
